LIQUOR regulations

Regulations under the Liquor Act 1978

Part 1Preliminary matters 1Citation

These Regulations may be cited as the Liquor Regulations 1981.

2Commencement

These Regulations shall come into operation on 1 January 1982.

Part 2General matters 4Days and times at which liquor may be sold
  • (1)

    Subject to subregulation (1AA), the times and days that liquor may be sold for consumption away from the premises under a licence that authorises such sales are:

    • (a)

      Sunday to Friday (inclusive) – between 10.00am and 10.00pm; and

    • (b)

      Saturday and public holidays – between 9.00am and 10.00pm;

    or such shorter periods of time within the times specified in paragraphs (a) and (b), and on such days, as the Director-General may determine for a particular licence or particular licences.

  • (1AA)

    The times and days that liquor may be sold for consumption away from the premises under a store licence are:

    • (a)

      Monday to Friday (inclusive) – between 10.00am and 10.00pm; and

    • (b)

      Saturday and public holidays – between 9.00am and 10.00pm;

    or such shorter periods of time within the times specified in paragraphs (a) and (b), and on such days, as the Director-General may determine for a particular store licence or particular store licences.

  • (1A)

    However, the Director-General may permit a licensee to sell liquor for consumption away from the premises at times other than those specified in or determined under subregulation (1) if satisfied that the liquor sold is not likely to be consumed in public or to lead to public drunkenness.

  • (1B)

    Where the Director-General gives permission under subregulation (1A) the Director-General must endorse the licensee’s licence accordingly.

  • (2)

    In this regulation:

    public holiday means a public holiday under section 5 or 6 of the Public Holidays Act 1981, other than Good Friday or Christmas Day.

5Application fee

The prescribed fee for section 26(1) of the Act is $200.

Part 2ALicence conditions 5APrescribed licences for section 31A of Act
  • (1)

    Section 31A of the Act applies to the sale of liquor to an individual under a licence that is subject to a condition under section 31 of the Act that allows the licensee to sell liquor for consumption away from the licensee’s licensed premises.

  • (2)

    However, section 31A of the Act does not apply to the sale of liquor under a licence listed in Schedule 1.

5BPersons subject to prohibition relating to purchase of liquor

For section 31A(2)(d) of the Act, the following provisions (as in force from time to time) are prescribed:

  • (a)

    a condition of a court order under section 11, 13, 39F(1)(c), 40, 44, 48F(1)(b) or 78K of the Sentencing Act 1995 relating to liquor;

  • (b)

    a condition of a court order made under section 83(1), or a family responsibility order made under section 140J, of the Youth Justice Act 2005 relating to liquor;

(c)     a condition of a parole order under the Parole Act 1971 (including a parole order registered under the Parole Orders (Transfer) Act 1981) relating to liquor;

  • (d)

    a child protection prohibition order under the Child Protection (Offender Reporting and Registration) Act 2004 relating to liquor;

  • (e)

    a supervision direction under section 123(1)(a)(i) of the Care and Protection of Children Act 2007 relating to liquor;

  • (f)

    a prohibition under section 42(3) of the Alcohol Harm Reduction Act 2017;

  • (g)

    a requirement, relating to liquor, of a supervision order as mentioned in section 19 of the Serious Sex Offenders Act 2013.

Part 2BWholesaler of liquor registration 5CFee for registration period

The prescribed fee for section 113A(4)(c)(ii) of the Act is as follows:

  • (a)

    for the registration period of 1 year – $20;

  • (b)

    for the registration period of 3 years – $60;

  • (c)

    for the registration period of 5 years – $100.

Part 3Infringement notices 6Definitions

In this Part:

Director-General infringement offence, see regulation 7(2).

infringement notice, see regulation 7A.

infringement offence means a police infringement offence or Director-General infringement offence.

police infringement offence, see regulation 7(1).

prescribed amount, see regulation 7(3).

7Infringement offences and
  • (1)

    A police infringement offence is an offence against a provision of the Act specified in Schedule 2, Part 1.

  • (2)

    A Director-General infringement offence is an offence against a provision of the Act specified in Schedule 2, Part 2.

  • (3)

    The prescribed amount for an infringement offence is the amount equal to the monetary value of the number of penalty units specified for the offence:

    • (a)

      for a police infringement offence – in Schedule 2, Part 1; or

    • (b)

      for a Director-General infringement offence – in Schedule 2, Part 2.

    7AWhen infringement notice may be
  • (1)

    If a police officer reasonably believes a person has committed a police infringement offence, the police officer may give a notice (an infringement notice) to the person.

  • (2)

    If the Director-General reasonably believes a person has committed a Director-General infringement offence, the Director-General may give a notice (an infringement notice) to the person.

8Contents of infringement notice
  • (1)

    The infringement notice must specify the following particulars:

    • (a)

      the name and address of the alleged offender, if known;

    • (b)

      the date of the infringement notice;

    • (c)

      the date, time and place of the infringement offence;

    • (d)

      a description of the infringement offence and the prescribed amount payable for the offence;

    • (e)

      the enforcement agency, within the meaning of the Fines and Penalties (Recovery) Act 2001, to whom the prescribed amount is payable.

  • (2)

    Also, the infringement notice must include a statement to the effect of the following:

    • (a)

      the alleged offender may expiate the infringement offence and avoid any further action in relation to the offence by paying the prescribed amount to the specified enforcement agency within 28 days after the notice is given;

    • (b)

      the alleged offender may elect under section 21 of the Fines and Penalties (Recovery) Act 2001 to have the matter dealt with by a court instead of under that Act by completing a statement of election and serving it on the specified enforcement agency;

    • (c)

      if the alleged offender does nothing in response to the notice, enforcement action may be taken under the Fines and Penalties (Recovery) Act 2001 which may result in any of the following:

      • (i)

        suspension of the alleged offender’s licence to drive;

      • (ii)

        seizure of personal property of the alleged offender;

      • (iii)

        deduction of an amount from the alleged offender’s wages or salary;

      • (iv)

        registration of a statutory charge on land owned by the alleged offender;

      • (v)

        making of a community work order for the alleged offender and imprisonment if the alleged offender breaches the order.

  • (3)

    In addition, the infringement notice must include an appropriate form for making the statement of election mentioned in subregulation (2)(b).

9Payment by cheque

If the alleged offender tenders a cheque in payment of the prescribed amount, the amount is not taken to have been paid unless the cheque is cleared on presentation.

10Withdrawal of infringement notice
  • (1)

    A police officer may withdraw an infringement notice given by a police officer by written notice given to the alleged offender.

  • (2)

    The Director-General may withdraw an infringement notice given by the Director-General by written notice given to the alleged offender.

  • (3)

    The notice must be given:

    • (a)

      within 28 days after the infringement notice is given to the alleged offender; and

    • (b)

      before payment of the prescribed amount.

    12Application of Part
  • (1)

    This Part does not prejudice or affect the start or continuing of proceedings for an infringement offence unless the offence is expiated and does not limit the penalty that may be imposed by a court for the offence.

  • (2)

    Also, this Part does not prevent more than one infringement notice for the same infringement offence being given to an alleged offender and, to expiate the offence, it is sufficient for the alleged offender to pay the prescribed amount in accordance with any of the notices.

  • (3)

    In addition, this Part does not require an infringement notice to be given and does not affect the liability of a person to be prosecuted in a court for an infringement offence for which an infringement notice has not been given.

Part 4Restricted areas 13Private premises that may be included in public restricted area
  • (1)

    This regulation has effect for section 74(1A) of the Act.

  • (2)

    A public restricted area may include any private premises specified in Schedule 3.
