No. XI.

An Ordinance for the better observance of the Lord's Day, and the more effectual prevention of Drunkenness.

HEREAS it is expedient that the Lord's Day be kept with Preamble,

Wdecency and propriety, and that all temptations to drunk-

enness and disorderly conduct be, as far as practicable, removed ;- Be it therefore enacted, by His Excellency the Governor of Western Australia and its Dependencies, by and. with the advice and consent of the Legislative Council thereof :—

I. THAT from and after the 1st day of July next following, if any licensed person between midnight of any Saturday and the midnight of any Lord's Day, shall keep open the outer door of his or her licensed. house, or of his or her separate tap or tap-room,

or sell or barter any spirirtuous or fermented liquors, whether for the purpose of being consumed on or off Iris or her licensed pre- mises, (except for the accommodation of bond fide Travellers or Lodgers,) every such licensed person, being convicted of such offence before any one or more Justice or Justices of the Peace, shall forfeit and pay any sum not exceeding £50.

II.

THAT if any licensed person shall sell, give, or deliver to any Aboriginal native of this colony, any quantity whatever of spirit- uous or fermented liquor, whether for the use of such native, or that of any other person, he shall, upon conviction thereof before any one or more Justices of the Peace, forfeit and pay a sum not exceeding £5 sterling.

III.      THAT every distinct act on. the same day of any such

selling, giving or delivering as aforesaid, shall be deemed a separate

offence.

IV. THAT sections A, B, and P of the Shortening Ordinance,

1853, shall be, and the same are hereby incorporated with this

Ordinance.
