Liquor Licensing (Prohibition of Certain Liquor) Amendment Act 2015

An Act to amend the Liquor Licensing Act 1997.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Liquor Licensing (Prohibition of Certain Liquor) Amendment Act 2015.

2Commencement

This Act will come into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Liquor Licensing Act 1997
4Amendment of section 131AA – Prohibition of manufacture, sale or supply of certain liquor

Section 131AA(3)—delete subsection (3) and substitute:

  1. (3)

    A declaration under subsection (2) may only be made in relation to particular liquor if the Minister is satisfied that—

    1. (a)

      the liquor is likely to have a special appeal to minors; or

    2. (b)

      the liquor is likely be confused with confectionery or a non‑alcoholic beverage; or

    3. (c)

      it is otherwise in the public interest to prohibit the manufacture, sale or supply (as the case requires) of the liquor.
