Liquor Licensing (Authorised Persons) Amendment Act 2006

An Act to amend the Liquor Licensing Act 1997.

The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Liquor Licensing (Authorised Persons) Amendment Act 2006.

2—Commencement

This Act will come into operation on 1 February 2007.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Liquor Licensing Act 1997

4—Amendment of section 4—Interpretation

Section 4—after the definition of approved crowd controller insert:

authorised person, in relation to licensed premises, means—

  1. (a)

    the licensee; or

  2. (b)

    a responsible person for the licensed premises; or

  3. (c)

    a police officer; or

  4. (d)

    an approved crowd controller;

5—Amendment of section 111—Areas of licensed premises may be declared out of bounds to minors

Section 111(3)—delete "the licensee, an agent or employee of the licensee, or a police officer" and substitute:

an authorised person

6—Amendment of section 112—Minors not to enter or remain in certain licensed premises

Section 112(2)—delete "the licensee, an employee of the licensee, or a police officer" and substitute:

an authorised person

7—Amendment of section 115—Evidence of age may be required

  1. (1)

    Section 115(1)—delete "an authorised" and substitute:

    a prescribed

  2. (2)

    Section 115(1)—delete "the authorised" and substitute:

    the prescribed

  3. (3)

    Section 115(3)—definition of authorised person—delete "authorised" and substitute:

    prescribed

8—Amendment of section 116—Power to require minors to leave licensed premises

  1. (1)

    Section 116(3a) and (3b)—delete subsections (3a) and (3b)

  2. (2)

    Section 116(4), definition of authorised person—delete the definition

9—Amendment of section 124—Power to refuse entry or remove persons guilty of offensive behaviour

  1. (1)

    Section 124(1a) and (1b)—delete subsections (1a) and (1b)

  2. (2)

    Section 124(6)—delete subsection (6)

10—Amendment of section 127—Power to remove person who is barred

Section 127(2a) to (3) (inclusive)—delete subsections (2a) to (3)

11—Amendment of section 131A—Failing to leave licensed premises on request

Section 131A(2)—delete subsection (2)

12—Insertion of section 137B

After section 137A insert:

137B—Procedures to be observed by authorised persons in prevention of persons from entering, and removal of persons from, licensed premises

  1. (1)

    The regulations may prescribe procedures to be observed by authorised persons in or in connection with the prevention of persons from entering, or the removal of persons from, licensed premises or a part of licensed premises.

  2. (2)

    The regulations may prescribe procedures to be observed by authorised persons in or in connection with the removal of minors from licensed premises or a part of licensed premises.

  3. (3)

    An authorised person must comply with the procedures (if any) prescribed under this section.
