Liquor Control Amendment Regulations

(No. 4) 2013

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Liquor Control Amendment
Regulations (No. 4) 2013.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Liquor Control Regulations 1989.

4.             Regulation 9F replaced

Delete regulation 9F and insert:

9F. Kinds of permit prescribed (Act s. 38(1)(b))
(1) For the purposes of section 38(1)(b), the following
kinds of permits are prescribed —

(a)

an extended trading permit to be issued for the purpose referred to in section 60(4)(ca) (other than an extended trading permit to which subregulation (2) applies);

(b)

an extended trading permit to be issued for the purpose referred to in section 60(4)(g) and for a specified period exceeding 3 weeks.

(2) This subregulation applies to an extended trading
permit to be issued in respect of a restaurant licence if,
when the permit is issued, the licence will be the
subject of a condition limiting the maximum number of
persons who may be on the licensed premises to 120 or

fewer, the licensee having declared in the application

for the permit —

(a) that the maximum number of persons who may be on the licensed premises when the application is made is 120 or fewer; or
(b) if paragraph (a) does not apply — that the
licensee consents to the imposition on the
licence of a condition limiting the maximum
number of persons who may be on the licensed
premises to 120.

5.             Schedule 3 amended

Delete Schedule 3 item 7 and insert:

7.           Application for extended trading permit for a period of

over 21 days —

(a) issued for the purpose referred to in

section 60(4)(ca) —

(i) if regulation 9F(2) applies ..................................... 50
(ii) if regulation 9F(2) does not apply ......................... 431
(b) issued for the purpose referred to in
section 60(4)(h) ............................................................. 323
(c) issued for any other purpose ......................................... 1 079
