Liquor Amendment (Special Licence

Conditions) Regulation (No 2) 2013

under the

Liquor Act 2007

Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Liquor Act 2007.

Explanatory note
The objects of this Regulation are as follows:

(a) to change the list of licensed premises that are subject to the special licence conditions set out in Schedule 4 to the Liquor Act 2007 (the Act),
(b) to enable the Director-General of the Department of Trade and Investment, Regional Infrastructure and Services to exempt parts of licensed premises from the special licence conditions set out in Schedule 4 to the Act without imposing alternative conditions.

This Regulation is made under the Act, including sections 11 (1A) and 159 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Liquor Amendment (Special Licence Conditions) Regulation
(No 2) 2013.

2      Commencement

This Regulation commences on 1 December 2013 and is required to be published on the NSW legislation website.

Schedule 1 Amendment of Liquor Act 2007 No 90

[1]      Schedule 4 Special licence conditions for declared premises

Omit Tables 1 and 2 from clause 1. Insert instead:

[2]      Schedule 4, clause 2 Special licence conditions

Omit clause 2 (2A). Insert instead:

(2A) This Schedule does not apply in relation to a newly specified licence until 8 December 2013. For the purposes of this subclause, a newly specified licence is a licence that was not specified in Table 1 or Table 2 to clause 1 immediately before the substitution of those Tables by the Liquor Amendment (Special Licence Conditions) Regulation (No 2) 2013.

[3]      Schedule 4, clause 8 Exemptions in relation to entire declared premises

Omit “the declared premises” from clause 8 (1).
Insert instead “the whole of the premises”.

[4]      Schedule 4, clause 8 (1), note

Insert at the end of the subclause:

Note. Any such order may be amended or repealed by virtue of section 43 (2) of the
Interpretation Act 1987.

[5]      Schedule 4, clause 8 (2)

Insert “the whole of” before “declared premises” where firstly occurring.

[6]      Schedule 4, clause 8 (5)

Omit the subclause.

[7]      Schedule 4, clause 8A

Insert after clause 8:

8A Exemptions in relation to parts of declared premises

The Director-General may, by order in writing served on the licensee of declared premises, exempt part of the premises (the exempted area) from any specified provision of this Schedule if the Director-General is satisfied that:

(a) the risk of alcohol-related violence is low in the exempted area, and

(b)

an exemption would not increase the risk of alcohol-related violence in the exempted area, and

(c)

adequate measures will be in place to minimise the risk of alcohol-related violence in the exempted area.

Note. Any such order may be amended or repealed by virtue of section 43 (2) of the
Interpretation Act 1987.
