Liquor Amendment (Special Events Extended Trading) Regulation 2015

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Liquor Act 2007.

Explanatory note
The object of this Regulation is to amend the Liquor Regulation 2008:

(a) to allow hotels and clubs to trade for extended periods on the days on which the NRL Grand Final and certain matches in the 2015 Rugby World Cup are held, and
(b) to ensure that RSA marshals may be required to produce their RSA certification to police officers or inspectors on request.

This Regulation is made under the Liquor Act 2007, including sections 13, 99 (2) (c) and 159 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Liquor Amendment (Special Events Extended Trading)
Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Liquor Regulation 2008

(1) Clause 38A

Omit the clause. Insert instead:

38A Extended trading for hotels and clubs

For the purposes of section 13 of the Act, the following periods are prescribed as periods during which liquor may be sold or supplied for consumption on the premises to which a hotel licence or club licence relates:

(a)

the period of 5 hours from midnight until 5 am on 24 September 2015 and on 11, 18 and 25 October 2015,

(b)

the period of 2 hours from 10 pm until midnight on 27 September 2015 and on 4 October 2015,

(c) the period of 5 hours from 5 am until 10 am on 4 October 2015,

(d)

the period of 4 hours from 1 am until 5 am on 19 and 26 October 2015,

(e)

the period of 6 hours from midnight until 6 am on 1 November 2015.

(2) Clause 39D Inspection of recognised RSA certification
Omit clause 39D (1). Insert instead:
(1) A police officer or inspector may require any person who is required to hold a recognised competency card or interim RSA certificate to produce his or her card or certificate to the officer or inspector for inspection.
