Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Liquor Act 2007.

Explanatory note
The objects of this Regulation are:

(a)

to give hotels and clubs extended trading hours during or around those times that certain special sporting events are held, namely, the matches of the Asian Cup (soccer) in which Australia is playing, the one-day cricket matches between Australia and England and the final of the Australian Open (tennis), and

(b)

to provide for a partial reduction in the 3-hour lock out period (ie 2 am to 5 am) that applies to certain venues under the special licence conditions in Schedule 4 to the Liquor Act 2007 so as to enable patrons to enter such a venue to watch certain matches of the 2011 Asian Cup.

This Regulation is made under the Liquor Act 2007, including sections 11 (1A) and 13.

1      Name of Regulation

This Regulation is the Liquor Amendment (Special Events—Extended
Trading Periods) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

Clause 38A

Omit clauses 38A and 38B. Insert instead:

38A Extended trading periods for hotels and clubs

For the purposes of section 13 of the Act, the following periods are prescribed as periods during which liquor may be sold or supplied for consumption on the premises to which a hotel licence or club licence relates:

(a)

the period of 3 hours between midnight and 3 am on any of the following days:

(i) Saturday 15 January 2011,
(ii) Wednesday 19 January 2011,

(b)

the period of 2 hours between 10 pm and midnight on any of the following days:

(i) Sunday 16 January 2011,
(ii) Sunday 23 January 2011,
(iii) Sunday 30 January 2011,
(iv) Sunday 6 February 2011,

(c)

the period of 3.5 hours between midnight and 3.30 am on Sunday 23 January 2011 (but only if Australia is playing in a quarter-final of the 2011 Asian Cup scheduled to commence on that day at 12.25 am),

(d)

the period of 6.5 hours between midnight and 6.30 am on Sunday 23 January 2011 (but only if Australia is playing in a quarter-final of the 2011 Asian Cup scheduled to commence on that day at 3.25 am),

(e)

the period of 3.5 hours between midnight and 3.30 am on Wednesday 26 January 2011 (but only if Australia is playing in a semi-final of the 2011 Asian Cup scheduled to commence on that day at 12.25 am),

(f)

the period of 5 hours between midnight and 5 am on Wednesday 26 January 2011 (but only if Australia is playing in a semi-final of the 2011 Asian Cup scheduled to commence on that day at 3.25 am),

(g)

the period of 5 hours between midnight and 5 am on Saturday 29 January 2011 (but only if Australia is playing in the play-off for third place in the 2011 Asian Cup at any time during that period),

(h)

the period of 6 hours between midnight and 6 am on Sunday 30 January 2011 (but only if Australia is playing in the final of the 2011 Asian Cup at any time during that period).

Schedule 4 Special licence conditions for declared premises

Omit clause 3 (1A). Insert instead:

(1A) The lock out period commences at 3.30 am and ends at 5 am on
the following days:
(a) Sunday 23 January 2011 (but only if Australia is playing in a quarter-final of the 2011 Asian Cup scheduled to commence on that day at 3.25 am),
(b) Wednesday 26 January 2011 (but only if Australia is playing in a semi-final of the 2011 Asian Cup scheduled to commence on that day at 3.25 am).
(1B) The lock out period commences at 2.05 am and ends at 5 am on
the following days:
(a) Saturday 29 January 2011 (but only if Australia is playing in the play-off for third place in the 2011 Asian Cup),
(b) Sunday 30 January 2011 (but only if Australia is playing in the final of the 2011 Asian Cup).
