s1 3 s4 Liquor Amendment Regulation (No. 3) 2006 No. 67, 2006 1 Short title This regulation may be cited as the Liquor Amendment Regulation (No. 3) 2006 . 2 Commencement This regulation commences on 5 June 2006. 3 Regulation amended This regulation amends the Liquor Regulation 2002. 4 Replacement of sch 1A (Aurukun) Schedule 1A— omit, insert— ‘Schedule 1A Aurukun sections 37A and 37B ‘1 Area declared to be restricted area ‘Each of the following areas is a restricted area— (a) the area of the Shire of Aurukun; (b) the foreshore of the area of the shire. ‘2 Prescribed quantity ‘(1) The prescribed quantity for each restricted area, other than the licensed premises known as the Three Rivers Tavern, is zero. ‘(2) The prescribed quantity for the Three Rivers Tavern is— (a) for beer in which the concentration of alcohol is no more than 4%—any quantity; and (b) for diluted spirit—any quantity; and (c) for any other liquor—zero. ‘(3) In this section—

s5 4 s5 Liquor Amendment Regulation (No. 3) 2006 No. 67, 2006 diluted spirit means a spirit mixed with a beverage in which the concentration of alcohol is not more than 5.5% of the beverage at 20ºC.’. 5 Replacement of sch 1C (Napranum) Schedule 1C— omit, insert — ‘Schedule 1C Napranum sections 37A and 37B ‘1 Areas declared to be restricted areas ‘Each of the following areas is a restricted area— (a) the community area of the Napranum Shire Council, other than the part of the road known as the Peninsula Development Road within the external boundaries of the land described as lot 2 on crown plan WP50; (b) the foreshore of the community area of the Napranum Shire Council. ‘2 Prescribed quantity ‘(1) The prescribed quantity for each restricted area, other than the licensed premises known as the Napranum Choolathah Tavern, is zero. ‘(2) The prescribed quantity for the Napranum Choolathah Tavern is— (a) for beer in which the concentration of alcohol is no more than 4%—any quantity; and (b) for diluted spirit—any quantity; and (c) for any other liquor—zero. ‘(3) In this section—

(2) Schedule 1D, section 1— insert — ‘(b) the foreshore of the community area of the Lockhart River Shire Council;’. (3) Schedule 1D, section 2(1), ‘the restricted’— omit, insert — ‘each restricted’. (4) Schedule 1D, section 2(2)(b)— omit, insert — ‘(b) for any other liquor—zero.’. 7 Amendment of sch 1E (Woorabinda) Schedule 1E, section 2(c) and (d)— omit, insert — ‘(c) for wine—2L; and (d) for any other liquor—zero.’. 8 Amendment of sch 1F (Wujal Wujal) (1) Schedule 1F, section 1— omit, insert— ‘1 Areas declared to be restricted areas ‘(1) Each of the following areas is a restricted area— (a) the community area of the Wujal Wujal Shire Council, other than the following areas—

s9 6 s9 Liquor Amendment Regulation (No. 3) 2006 No. 67, 2006 (i) the car park near the Bloomfield Falls; (ii) the part of the road known as the Bloomfield Track within the external boundaries of the land described as lot 42 on plan SR837; (iii) the parts of the roads known as Douglas Street and the Rossville-Bloomfield Road within the external boundaries of the land described as lot 4 on plan SR836; (iv) the road directly connecting the road known as Douglas Street and the Bloomfield Falls; (b) the foreshore of the community area of the Wujal Wujal Shire Council. ‘(2) To remove any doubt it is declared that the road mentioned in subsection (1)(a)(iv) does not include the road that is known as the service road for Douglas Street.’. (2) Schedule 1F, section 2, ‘the restricted’— omit, insert — ‘each restricted’. 9 Amendment of sch 1G (Kowanyama) (1) Schedule 1G, section 1— omit, insert — ‘1 Areas declared to be restricted areas ‘Each of the following areas is a restricted area— (a) the community area of the Kowanyama Shire Council; (b) the Mitchell-Alice Rivers National Park; (c) the foreshore of the community area.’. (2) Schedule 1G, section 2(2)(c)— omit, insert — ‘(c) for any other liquor—zero.’.

(2) Schedule 1H, section 2(1), ‘the restricted’— omit, insert — ‘each restricted’. (2) Schedule 1P, section 2(1), ‘the restricted’— omit, insert — ‘each restricted’. 18 Replacement of sch 1Q (Mapoon) Schedule 1Q— omit, insert — ‘Schedule 1Q Mapoon sections 37A and 37B ‘1 Areas declared to be restricted areas ‘Each of the following areas is a restricted area— (a) the community area of the Mapoon Shire Council; (b) the foreshore of the community area. ‘2 Prescribed quantity ‘(1) The prescribed quantity for each restricted area is— (a) for beer in which the concentration of alcohol is less than 4%—22.5L; and (b) for wine, other than fortified wine—2L; and (c) for diluted spirit—9L; and

s 19 11 s 19 Liquor Amendment Regulation (No. 3) 2006 No. 67, 2006 (d) for any other liquor—zero. ‘(2) In this section— diluted spirit means a spirit mixed with a beverage in which the concentration of alcohol is not more than 5.5% of the beverage at 20ºC. fortified wine includes muscat, port and sherry.’. 19 Amendment of sch 2 (Dictionary) Schedule 2— insert — ‘ foreshore , of the area of a shire or a community area, means land that— (a) is adjacent to a boundary of the area formed by waters that are subject to tidal influence; and (b) lies between high-water mark and low-water mark at ordinary spring tides.’.
