Liquor Amendment Regulation 2014

under the

Liquor Act 2007

Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Liquor Act 2007.

Explanatory note
The object of this Regulation is to amend the Liquor Regulation 2008:

(a) to put it beyond doubt that liquor sales cessation periods and lock out periods within the meaning of that Regulation apply on every day, and
(b) so that the application of provisions of that Regulation relating to liquor sales cessation periods and lock out periods on premises that are high risk venues (within the meaning of sections 116AA and 116B of the Liquor Act 2007) in those precincts will be limited to so much of such venues as are declared to be subject premises or CBD subject premises by an order made by the Secretary of the Department of Trade and Investment, Regional Infrastructure and Services.

This Regulation is made under the Liquor Act 2007, including sections 116A, 116I and 159 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Liquor Amendment Regulation 2014.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

Schedule 1 Amendment of Liquor Regulation 2008

[1]      Clause 3 Definitions

Insert “of the week” after “day” wherever occurring in the definitions of liquor sales cessation period and lock out period in clause 3 (1).

[2]      Clause 53C “Lock outs” for certain subject premises

Omit paragraph (d) of the definition of subject premises from clause 53C (1). Insert instead:

(d) so much of a high risk venue (within the meaning of section 116AA of the Act) as is declared by the Director-General by an order in writing to be subject premises for the purposes of this clause,

[3]      Clause 53D Liquor sales cessation period

Omit paragraph (d) of the definition of subject premises from clause 53D (1). Insert instead:

(d) so much of a high risk venue (within the meaning of section 116AA of the Act) as is declared by the Director-General by an order in writing to be subject premises for the purposes of this clause,

[4]      Clause 53Y “Lock outs” for certain CBD subject premises

Omit paragraph (d) of the definition of CBD subject premises from clause 53Y (1).
Insert instead:
(d) on and from 15 March 2014—so much of a high risk venue (within the meaning of section 116B of the Act) as is declared by the Director-General by an order in writing to be CBD subject premises for the purposes of this clause,

[5]      Clause 53Z Liquor sales cessation period

Omit paragraph (d) of the definition of CBD subject premises from clause 53Z (1).
Insert instead:
(d) on and from 15 March 2014—so much of a high risk venue (within the meaning of section 116B of the Act) as is declared by the Director-General by an order in writing to be CBD subject premises for the purposes of this clause,
