1Name of Act

This Act is the Liquor Amendment (Racing Clubs) Act 2004.

2Commencement

This Act commences on the date of assent.

3Amendment of Liquor Act 1982 No 147

The Liquor Act 1982 is amended as set out in Schedule 1.

Schedule 1Amendments

(Section 3)

[1]Section 19 Governor’s licences

Omit section 19 (1) (d). Insert instead:

  • (d)

    on premises occupied by a racing club,

  • [2]Section 133 Liquor in unregistered club

    Insert after section 133 (2):

    (2A)

    A reference in subsection (1) or (2) to the premises of an unregistered club does not include a reference to the licensed premises of a racing club.

    [3]Section 134 Persons within unregistered club

    Insert “or the licensed premises of a racing club” after “relates”.

    [4]Section 151 Search warrants

    Insert “(other than a racing club that is authorised by a licence to sell liquor)” after “unregistered club” in section 151 (3) (c) (ii).

    [5]Section 151 (3) (d)

    Insert “(other than the licensed premises of a racing club)” after “unregistered club”.

    [6]Schedule 1 Savings and transitional provisions

    Insert at the end of clause 1 (1):
