Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Liquor Act 2007.

Explanatory note
The object of this Regulation is to ensure that liquor must not, in the case of late trading venues in the Kings Cross precinct that are required to cease trading after 5 am on Saturday or Sunday mornings, be sold or supplied between 4 am and 5 am on any such day.

This Regulation is made under the Liquor Act 2007, including section 116A (Regulatory controls for licensed premises in Kings Cross precinct).

1      Name of Regulation

This Regulation is the Liquor Amendment (Kings Cross Late Trading
Venues) Regulation 2012.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clause 53C Service of alcohol to cease one hour before late closing time on weekends

Insert at the end of the clause:

(2) Subclause (1) does not apply to subject premises that are required to cease trading after 5 am on any Saturday or Sunday morning.
Note. These premises are subject to the 1-hour time-out under clause 53D.

[2]      Clause 53D

Omit the clause. Insert instead:

53D “Time-outs” for certain premises

If subject premises:

(a)

are not required to cease trading after 2 am on any Saturday or Sunday morning, or

(b)

are required to cease trading after 5 am on any Saturday or Sunday morning,

liquor must not be sold or supplied on the premises between 4 am
and 5 am on any such day.
