LIQUOR ACTS AMENDMENT [ASSENTED TO 3RD SEPTEMBER, 1923.] B AOT OF 1923. • E It enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The Liquor Acts : ~ struction Amendm~ nt Act of 1923," and shal~ be rea~ as one with .of Act. *" The L~quor Acts, 1912-1920," herem collectIvely referred to as the Principal Act. Amendment 2. Subsection four of section forty-four of the (If s. 44. Principal Act is repealed and the following subsection is inserted in lieu thereof:- " (4.) (1.) All billiard rooms and bagatelle rooms on the premises of a licensed victualler or wine seller shall only be kept open during such hours as are prescribed by the regulations, and any person who during such hours is on such premises merely for the purpose of playing billiards or bagatelle shall not be deemed guilty of an offence against section eighty-five of this Act. (2.) If the hours so prescribed are not the same as are prescribed by this Act with respect to the sale of liquor on such premises, the regulations may prescribe conditions upon which such rooms may be permitted to remain open during the time when such premises are not permitted to be open for the sale of liquor." Amendment 3. The following provision is added to subsection .of s. 58. (i.) of section fifty-eight of the Principal Act : - "Upon the hearing of any such application the applicant shall submit evidence to the court in support of his application; and where in any such case the inspector of the district is the applicant he may, for the purpose of obtaining evidence that may be of assistance to the court, require the licensee or any other person who is in his opinion capable of giving information, to answer questions put to him by the inspector, * 3 Geo, V. Liquor Acts A_mendment Act. and such licensee or other person shall answer such questions accordingly; and the inspector may require the licensee to produce to him the books, papers, and accounts relating to his business as a licensed victualler and to permit him to inspect the same and make copies thereof or extracts therefrom. Any such licensee or other person who,being required as aforesaid, refuses to answer any such question or in making such answer furnishes a wilfully incorrect statement or particulars, and any such licensee who, being required as aforesaid, refuses to produce such books, papers, or accounts as aforesaid, or to permit inspection thereof or the making of any such copies or extracts, shall be liable to a penalty not exceeding fifty pounds." 4. In subsection one of section eighty-one of the Amendment Principal Act, the words "between the hours of six in of s. 81. the morning and eleven at night" are repealed, and the words" between the hours of eight in the morning and eight at night" are inserted in lieu thereof. 5. In paragraph (a) of subsection one of section Amendment one hundred and forty-seven of the Principal Act, the of s. 147. words "between the hours of six in the morning and eleven at night" are repealed, and the words " between the hours of eight in the morning and eight at night" are inserted in lieu thereof. In the first, paragraph of section one hundred and Amendment fifty-one of the Principal Act, after the words "section of s. 151 one hundred and twenty-eight" the following words are inserted :- "Section one hundred and forty-seven of this Act, as amended by "The Liquor Acts Amendment Act of 1923," shall apply to every such club from and after the passing of the last-mentioned Act." r

The following provision is added to section one of s. 168. hundred and sixty-eight of the Principal Act :-- "In the event of a local option vote being taken in any local option area in the year one thousand nine hundred and twenty-five, as provided by section one hundred and seventy of this Act, the next local option vote in any area cannot be taken until the year one thousand nine hundred and twenty-eight, and local option votes may be so taken in any area in every third year thereafter." Amendment 9. In subsection one of section one hundred and of s. 176. seventy-six of the Principal Act, the words" at the next ensuing Senate election" are repealed and the words "on any day fixed for a local option poll thereafter" are inserted in lieu thereof. Amendment 10. In paragraph (b) of subsection two of section one of s. 187. hundred and eighty-seven of the Principal Act, after the word" fuel" the words" or to prohibit the sale or supply of wine for sacramental purposes" are inserted. Amendment 11. In paragraph (c) of subsection six of section of s. 191A. 191A of the Principal Act, after the word" fuel" the words "or to prohibit the sale or supply of wine for sacramental purposes" are inserted.
