Liquor Amendment (Penalty Notices) New South Wales

Regulation 2000

under the

Liquor Act 1982

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Liquor Act 1982.

Explanatory note
Sections 117E, 117EB, 117EC and 117ED of the Liquor Act 1982 create
various offences relating to evidence of age (such as “proof of age” cards).

The objects of this Regulation are:

(a)

to make the penalty payable by a minor who has been served with a penalty notice in relation to any of those offences $110 instead of the penalty of 0.5 penalty units (currently $55) applicable to any other penalty notice offence by a minor, and

(b)

to fix at $55 the penalty applicable to those other penalty notice offences by minors, and

(c)

to prescribe short descriptions and Infringement Processing Bureau codes for the offences under sections 117EB, 117EC and 117ED of the Act.

This Regulation is made under the Liquor Act 1982, including sections 145A

(Penalty notices) and 156 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Liquor Amendment (Penalty Notices)

Regulation 2000.

2 Commencement

This Regulation commences on 3 March 2000.

3 Amendment of Liquor Regulation 1996

The Liquor Regulation 1996 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

[1]      Clause 87 Penalty notice offences

Omit clause 87 (b) (ii).
Insert instead:

(ii)       in the case of a penalty notice served on a

minor:

(A) in respect of an offence under section 117E (2) or (3), 117EB (1), (2) or (3), 117EC or 117ED of the Act—$110, or
(B) in respect of an offence under any other
provision of the Act—$55.
