His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Liquor Act 1982.

Explanatory note

Under section 23 (3A) of the Liquor Act 1982, it is a condition of certain liquor on-licences that the business carried on under the licence must be a business of selling liquor to the general public resorting to the licensed premises and must not be limited to selling liquor only to certain classes of persons resorting to the premises. However, the regulations may provide exceptions to this requirement.

The object of this Regulation is to provide for an exemption in respect of the GIO Mona Vale Conference Centre which restricts its clientele to conference delegates. As a result of this Regulation, the business carried on under the on-licence relating to those premises may be limited to the sale of liquor only to persons who are attending conferences or functions at the Centre.

This Regulation also updates an existing exemption in respect of the British
Aerospace Flight Training Academy at Tamworth.
This Regulation is made under the Liquor Act 1982, including section 23

(3A) and section 156 (the general regulation making power).

1 Name of Regulation

This Regulation is the Liquor Amendment (GIO Conference

Centre Exemption) Regulation 1997.

2 Amendment of Liquor Regulation 1996

The Liquor Regulation 1996 is amended as set out in Schedule 1.

Omit the clause. Insert instead:

83 Exceptions from section 23 (3A) of the Act

For the purposes of section 23 (3A) of the Act, each of the businesses specified in column 1 of the following Table may be or include a business limited at any time only to selling or supplying liquor to the particular class or classes of persons specified in column 2 opposite the business concerned.
