His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Liquor Act 1982.

note

The object of this Regulation is to amend the Liquor Regulation 1996:

to enable the Technical Standards for Gaming Machines and Subsidiary Equipment in New South Wales, which is referred to as effective as from 1 July 1995 in the definition of an “X” standard gaming machine in the Regulation, to be referred to as in force from time to time following an amendment to the general regulation-making power in the Liquor Act 1982 by the Liquor and Registered Clubs Legislation Amendment Act 1997 (Schedule 1 [ l ] ) . and

to make the language of clause 46B consistent with section 161 of the Liquor Act 1982 following amendment of that section by the Registered Clubs and Liquor Legislation Amendment Act 1997 (Schedule 1 [2]), and

except at times when liquor may be sold or supplied in the areas in
to prescribe as a condition of a hotelier‘s licence that approved poker machines kept on the licensed premises must not be used or operated
which the machines are kept (Schedule 1 [3)).

This Regulation is made under the Liquor Act 1982, including sections 20.

156 (the general replation-making power) and 161 (11).

Devices) Regulation 1998.

Amendment of Liquor Regulation 1996

The Liquor Regulation 1996 is amended as set out in Schedule 1 .

Schedule 1 Amendments

(Clause 2)

Omit "effective as from 1 July 1995" from the definition of “X”
standard gaming machine.
Insert instead "as in force from time to time”.

Clause 46B Location of approved gaming devices in hotel gaming room-section 161 (11) of Act

Omit "used and operated" from clause 46B (1). insert instead "kept, used or operated".

Omit the clause. Insert instead:

46C Location and operation of poker machines in hotels

The following are conditions of a hotelier's licence:

(a) any approved poker machine kept by the hotelier on the licensed premises must be located in a restricted area of the hotel.
(b) any approved poker machine kept by the hotelier on the licensed premises must not be used or operated at any time other than a time at which liquor may be sold or supplied in the restricted area in which the poker machine is kept.
