848 Liquefied Petroleum Gas Subsidy Act Commencement Act 1981, No. 84 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Liquefied Petroleum Gas Subsidy Act Commencement Act 1981. 2. Citation . (1) In this Act the Liquefied Petroleum Gas Subsidy Act1980 is referred to as the Principal Act. (2) In this Act the Principal Act as amended by the Liquefied PetroleumGas Subsidy Act Amendment Act1981 is referred to as the Amended Act. 3. Commencement of Principal Act. The Principal Act shall be deemed to have commenced on the day it was assented to for and on behalf of Her Majesty, that is 22 September, 1980, notwithstanding the provisions of section 2 thereof. 4. Validation . (1) Every exercise of a power or discretion conferred by the Principal Act or the Amended Act and every performance of a duty or making of a requirement provided for by the Principal Act or the Amended Act before the commencement of this Act shall be deemed to have had the effect prescribed by the Principal Act or, as the case may be, the Amended Act that it would have had if the Principal Act or, as the case may be, the Amended Act had been in force at the time of the exercise, performance or making. (2) Every liability to punishment for an offence or to pay moneys, being a consequence provided for by the Principal Act or the Amended Act of an act or omission that occurred before the commencement of this Act, shall be deemed to have been incurred in accordance with the Principal Act as if that Act had been in force at the time of the occurrence of that act or omission. (3) Every regulation purporting to have been made under the Principal Act or the Amended Act and to be in force before the commencement of this Act shall be deemed to have been in force and to have taken effect on and from the date on which it purports so to do as if the Principal Act or, as the case may be, the Amended Act had been in force at that date. 5. Liability for actions . A person who at any time before the commencement of this Act has purported to exercise a power or discretion, performed a duty or made a requirement referred to in section 4 (1) or to enforce or has taken steps with a view to enforcing a liability referred to in section 4 (2) and in any such case has purported to act pursuant to the Principal Act or the Amended Act shall be taken not to have incurred a liability in law to a greater extent than he would have incurred had the Principal Act or, as the case may be, the Amended Act been in force at the material time.

In section 4 (1) and (2) and in section 5 the expression " Principal Act " includes regulations purporting to have been made under that Act and the expression "Amended Act " includes regulations purporting to have been made under that Act.
