An Act to amend the Liquefied Petroleum Gas Act, 1961, so as to omit certain regulation making powers under that Act, and for other purposes. [Assented to, 12th May, 1982.]

Liquefied Petroleum Gas (Dangerous Goods) Amendment.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—-

Short title.

1. This Act may be cited as the "Liquefied Petroleum Gas (Dangerous

Goods) Amendment Act, 1982".

Commencement.

2. (1) Except as provided in subsection (2), this Act shall commence

on the date of assent to this Act.

(2) Section 5, in its application to Schedule 1, and Schedule 1 shall commence on the day appointed and notified pursuant to section 2 (2) of the Dangerous Goods (Amendment) Act, 1982.

Principal Act.

3. The Liquefied Petroleum Gas Act, 1961, is referred to in this Act

as the Principal Act.

4.      This Act contains the following Schedules:—

SCHEDULE 1.—AMENDMENT TO THE PRINCIPAL ACT.

SCHEDULE 2.—AMENDMENTS TO THE PRINCIPAL ACT BY WAY OF

STATUTE LAW REVISION.

Amendment of Act No. 3, 1961.

5. The Principal Act is amended in the manner set forth in Schedules

1 and 2.

AMENDMENT TO THE PRINCIPAL ACT.

Section 7 (1) (c)—

Omit the paragraph.

SCHEDULE 2.

AMENDMENTS TO THE PRINCIPAL ACT BY WAY OF STATUTE LAW REVISION.

(1) (a) Section 2, definition of "Council"—

Omit the definition.

(b) Section 2, definition of "Prescribed"—

Omit the definition.

(c) Section 2, definition of "Sell"—

Omit "; and 'sale' has a corresponding interpretation".

(d) Section 2, definition of "Testing officer"—

Omit "subsection (1) of section 4", insert instead "section 4

(1)" .

(2) Section 4 (1)—

Omit "1902, as amended by subsequent Acts,", insert instead

"1979,".

(3) (a) Section 7 (2 )—

Omit "paragraph (a) of subsection (1)", insert instead
"subsection (1) (a)".

(b) Section 7 (4 )—

Omit the subsection, insert instead:—

(4) Section 41 of the Interpretation Act, 1897, applies in
respect of a regulation as if this Act had been passed after the

commencement of the Interpretation (Amendment) Act, 1969.
