Application for approval of the Armaguard NSW Clerical and Administrative Employees Enterprise Agreement 2013.

[1] An application has been made for approval of an enterprise agreement known as the Armaguard NSW Clerical and Administrative Employees Enterprise Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Linfox Armaguard Pty Ltd. The agreement is a single-enterprise agreement.

[2] I am satisfied that each of the requirements of ss186, 187 and 188 as are relevant to this application for approval have been met.

[3] The New South Wales Local Government, Clerical, Administrative, Energy, Airlines and Utilities Branch of the Australian Services Union (ASU) and the Transport Workers’ Union of Australia (TWU), each being a bargaining representative for the Agreement, have given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers each organisation.

[4] The Agreement is approved and, in accordance with s.54, will operate from 11 October 2013. The nominal expiry date is 13 May 2015.

[5] It should be noted that Linfox Armaguard Pty Ltd has provided an undertaking in relation to recognition of the TWU’s status under the Agreement. The undertaking is not one made pursuant to s.190 of the Act. A copy of this undertaking is attached to the decision.
