Lighthouses and Light Dues Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Lighthouses Act 1911.

Commencement

1. These Regulations shall come into operation on 1 October 1982.

Interpretation

2. Regulation 13 of the Lighthouses and Light Dues Regulations is amended by omitting the definition of “tonnage” and substituting the following definition:

“ ‘tonnage’, in relation to a ship, means—

(a) where the net tonnage of the ship has been determined in accordance with a law of the Commonwealth or of any other country, being a law giving effect to the International Convention on Tonnage Measurement of Ships, 1969—the net tonnage so determined; and

(b) in any other case—the register tonnage of the ship.”.

Rate of light dues

3. Regulation 15 of the Lighthouses and Light Dues Regulations is amended—

(a) by omitting “41 cents” and substituting “49 cents”; and

(b) by adding at the end thereof the following sub-regulation:

“(2) In sub-regulation (1), a reference to a ton does not include a part of a ton.”.

Vessels exempted

4. Regulation 20 of the Lighthouses and Light Dues Regulations is amended by omitting paragraph (f) and substituting the following paragraph:

“(f) a ship the tonnage of which does not exceed 30 tons;”.
