REGULATIONS UNDER THE LIGHTHOUSES ACT 1911-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Lighthouses Act 1911-1966.

Amendments of the Lighthouses and Light Dues Regulations.

Commencement.

1.These Regulations, other than regulations 2, 4 and 10, shall come into operation on the first day of October, 1967.

Fees, travelling allowance and fares.

2.—(1.) Regulation 11 of the Lighthouses and Light Dues Regulations is amended by omitting from sub-regulation (1.) the words “Seven pounds seven shillings” and inserting in their stead the words “Twenty-five dollars”.

(2.) Regulation 11 of the Lighthouses and Light Dues Regulations is amended by omitting from sub-regulation (2.) the words “at the rate of Three pounds six shillings per day” and inserting in their stead the words “at the rate specified in sub-regulation (2.) of regulation 75a of the Public Service Regulations as in force from time to time”.

(3.) Regulation 11 of the Lighthouses and Light Dues Regulations is amended by inserting after sub-regulation (2.) the following sub-regulation:—

“(2a.) Where a member, or the deputy of a member, attends a meeting of the Committee held in a city or town other than that in which he resides but is not absent overnight from his place of residence, he is entitled to receive for each meal purchased by him during the period for which he is necessarily absent from his place of residence an allowance in accordance with the following table:—

(4.) Regulation 11 of the Lighthouses and Light Dues Regulations is amended by omitting from sub-regulation (3.) the word “Council” and inserting in its stead the word “Committee”.

Definitions.

3.Regulation 13 of the Lighthouses and Light Dues Regulations is amended by omitting the definition of “tonnage” and inserting in its stead the following definition:—

“‘tonnage’, in relation to a ship, means net registered tonnage (excluding, if the tonnage contains a part of a ton, that part) of the ship.”.

Rate of light dues.

4.Regulation 15 of the Lighthouses and Light Dues Regulations is amended by omitting the words “One shilling and sixpence per ton” and inserting in their stead the words “Fifteen cents per ton”.

Light dues—when and to whom payable.

5. Regulation 16 of the Lighthouses and Light Dues Regulations is amended by inserting after paragraph (a) of sub-regulation (4.) the following paragraph:—

“(aa)to engage or discharge a member of the crew;”.

Refund of light dues.

6. Regulation 17 of the Lighthouses and Light Dues Regulations is amended by inserting after sub-regulation (1.) the following sub-regulation:—

“(1a.) Where a ship in respect of which light dues have been paid in accordance with paragraph (d)of sub-regulation (2.) of the last preceding regulation has subsequently been prevented from putting to sea for a continuous number of days exceeding thirty, any one of which occurs in the quarter in which the light dues were paid, the Collector may refund in respect of each such day that occurs in that quarter an amount ascertained by dividing the amount of light dues paid by a number equal to the number of days in that quarter for which light dues were paid.”.

Remission of light dues.

7. Regulation 18 of the Lighthouses and Light Dues Regulations is amended by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

“(3.) Where a ship in respect of which light dues have been paid under sub-regulation (1.) of regulation 16 of these Regulations has, at the end of a quarter, been, for a continuous period exceeding thirty days, and is, on the first day of the next succeeding quarter, prevented from putting to sea—

(a)by reason of the fact that it was and is out of commission;

(b) by reason of the fact that it was and is laid up for repairs; or

(c) consequent upon an industrial dispute,

the Collector may remit further payments of light dues until the ship is again placed in commission or is able to put to sea, as the case may be.”.

Production of a receipt for payment of light dues before clearance.

8. Regulation 19 of the Lighthouses and Light Dues Regulations is repealed.

Vessels exempted.

9. Regulation 20 of the Lighthouses and Light Dues Regulations is amended—

(a) by inserting after paragraph (c) the following paragraphs:—

“(ca) a pearling ship within the meaning of the Pearl Fisheries Act 1952-1966;

“(cb)a vessel wholly engaged in attending upon, or carrying stores for, a ship referred to in either of the last two preceding paragraphs;”;

(b)by omitting from paragraph (d)the words “or a pleasure yacht”;

(c) by omitting from paragraph (f) the words “fifteen tons gross register” and inserting in their stead the words “thirty tons net registered tonnage”; and

(d) by omitting paragraphs (j) and (k) and inserting in their stead the following word and paragraph:—

“or (j) a ship belonging to, requisitioned by or chartered by, the Commonwealth or the Government of any other country and engaged solely in carrying members of, or goods intended for the use of, the naval, military or air forces of the Commonwealth or of that other country.”.

Application.

10. Sub-regulation (1.) of regulation 11 of the Lighthouses and Light Dues Regulations as amended by these Regulations applies to and in relation to attendance at a meeting of the Committee held during the period from and including the first day of December, 1966, to and including the day immediately preceding the day on which these Regulations come into operation.
