WH E R E A S t h e advice of t h e Legis la t ive Counci l thereof passed in t h e
by a n Ac t of t h e Governor of N e w South W a l e s w i t h
t h i r d year of t he re ign of H i s la te Majes ty K i n g W i l l i a m t h e F o u r t h

i n t i t u l e d "An Act for the better preservation of the Ports Harbour's " Havens Roadstcads Channels Navigable Creeks and Rivers in New " South Wales and the better regulating of Shipping in the same " i t was a m o n g other t h ings enacted t h a t t h e mas t e r or commande r of

thereof Tha t subject to t he regula t ions hereinafter conta ined t h e mas t e r or commande r of every ship or vessel above the b u r t h e n of fifty tons which shall arr ive or come wi th in t h e H a r b o u r s of P o r t Macqua r i e or
every ship or vessel above t h e b u r t h e n of fifty tons which should arr ive
or come wi th in t h e H e a d s of P o r t J a c k s o n should pay in to t he h a n d s
of t h e Collector of Cus toms or his depu ty towards t h e m a i n t e n a n c e of

t h e L igh t -house a t t h e en t r ance of t h e said por t t h e several dues as t h e same are respectively inser ted described a n d set for th in figures in t h e tab le to t h e said reci ted A c t annexed m a r k e d w i t h t he le t te r E and all sums of money which should be so received by t h e Collector of Cus toms or his deputy should be pa id without any deduct ion whatso­ ever to t h e Colonial Treasurer for t h e m a i n t e n a n c e of t h e said L igh t ­

house a n d whereas i t is expedient t o au thor ize t he p a y m e n t of L igh t ­

house dues a t P o r t M a c q u a r i e Newcas t le a n d P o r t Ph i l l ip in t he Colony of N e w South Wales so soon as Light -houses are respectively established the rea t Be i t therefore enac ted by H i s Excel lency t h e Governor of N e w

Sou th W a l e s wi th t he advice a n d consent of t h e Legislat ive Counci l

or Newcas t le shal l pay in to t h e h a n d s of such officer as m a y be appoin ted by t h e Collector of Cus toms to receive t h e same the several dues set for th and specified in t h e Schedule to th i s A c t annexed

2. Provided a lways and be i t enacted Tha t no such L igh t -house dues shal l be payable in respect of any ship or vessel en te r ing t he said H a r b o u r s of P o r t Macqua r i e a n d Newcast le u n t i l L igh t -houses shal l be duly establ ished a t t he said places respectively a n d u n t i l not ice thereof shall have been given by t h e Governor w i th t he advice of t he Execu t i ve Council a t least one m o n t h previously in t h e New South

Wales Government Gazette Provided also t h a t i t shal l be lawful for
t he Governor wi th t h e advice of t h e said Execu t ive Counci l to reduce t h e ra tes respectively ment ioned in t h e said Schedule and to al ter and vary t he same from t ime to t ime as m a y be deemed necessary so t h a t t h e said ra tes shal l in no case exceed those s ta ted in t he said Schedule and t h a t all such a l tera t ions shal l i n l ike m a n n e r before t a k i n g effect

be publ ished a t least one m o n t h previously in t h e New South Wales
Government Gazette a t t h e exp i ra t ion of which t ime t h e same shall be

and cont inue thencefor th to be in full force and effect.
3. A n d be i t enacted T h a t all ra tes which previous to t he
pass ing of th i s Ac t m a y have been collected levied or received or

become due as L igh t -house charges a t P o r t Ph i l l ip u n d e r t h e R e g u ­

la t ions framed for t h e H a r b o u r of P o r t Ph i l l ip p u r s u a n t to t h e A c t of
t he Governor and Counci l in t i tu led " An Act for the better preserva-

" tion of the Ports Harbours Havens Roadsteads Channels Navigable " Creeks and Ilivers hi Neio South Wales and the belter regulation of " Shipping in the same" shal l be a n d t a k e n to be as val id a n d lawful

as if t h e same h a d been imposed by t h e au tho r i t y of t h e Leg i s la tu re .

4     A n d be i t enacted T h a t all sums received unde r t h e pro­

visions of th i s Ac t shal l be paid over to t h e Colonial Treasurer to be accounted for in l ike m a n n e r as o ther publ ic monies coming in to his h a n d s a n d shal l be applied in t h e m a i n t e n a n c e of t he L igh t -houses erected or to be erected a t t h e several places hereinbefore men t ioned in such m a n n e r as shal l from t ime to t ime be directed by any Ac t of t h e said Governor wi th t h e advice and consent of t h e said Legis la t ive Counci l .
