LIFE, FIRE AND MARINE

INSURANCE (AMENDMENT) ACT.

Act No. 21, 1938.

An Act to amend the Life, Fire and Marine sequent Acts, in certain respects; and for purposes connected therewith. [Assented to, 14th November, 1938.]

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis- Wales in Parliament assembled, and by the authority of
the same, as follows :—

1 . (1) This Act may be cited as the "Life, Fire and

Marine Insurance (Amendment) Act, 1938."

(2) The Life, Fire and Marine Insurance Act, 1902,
as amended by subsequent Acts, including' this Act, may
be cited as the Life, Fire and Marine Insurance Act,

2. The Life, Fire and Marine Insurance Act, 1902, as

amended by subsequent Acts, is amended —

(a) by inserting next after section ten the following new section:—

10A. A policy for an insurance upon the life of any person, whether issued before or after the commencement of the Life, Fire and Marine Insurance (Amendment) Act, 1938, shall not be and shall be deemed never to have been void or voidable merely on the ground that such person died by his own hand or act, if, upon the true construction of the policy, the insurance com­ pany has thereby agreed to pay the sum assured in the events that have happened.

(b) by omitting from the matter relating to Part I I in section one the figures " 1 0 " and by insert­

ing in lieu thereof the figures and letter " 1 0 A . "
