An Act to amend the-Law relating to Preferable Liens on Wool and Mortgages of Sheep. [1st February, 1868.]

| Majesty Queen Victoria numbered four certain provisions were made with respect to preferable Liens on Wool and Mortgages of Sheep Cattle and Horses And it was enacted that the said Act should remain in force for a limited time And whereas by another Act of the Governor and Legislative Council of New South Wales passed in the year aforesaid numbered fifty-eight it was declared and enacted that i t should not be lawful for the mortgagor of any sheep so long as any mortgage thereon executed by him should remain unsatisfied to grant a lien on the wool of such sheep any practice to the contrary notwithstanding And whereas the said first-mentioned Act was by sundry other Acts of the Governor and Legislative Council of New South Wales amended and from time to time continued in force and was afterwards by an Act of the Paliament of New South Wales passed in the twenty-third year of the reign of Her Majesty Queen Victoria numbered nine made perpetual And whereas it is expedient that provision be made for enabling the mortgagor of sheep notwithstanding that the mortgage thereon shall remain unsatisfied to grant with the consent of the mortgagee but not otherwise a lien on the next ensuing clip of the wool of such sheep Be it therefore; enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative | Council |
Council and Legislative Assembly of New South Wales in this present Parliament assembled and by the authority of the same as follows that is to say—
1. The several Acts and parts of Acts set forth in the Schedule hereto to the extent to which such Acts and parts of Acts are in and by such Schedule expressed to be repealed shall be and they are hereby respectively repealed.
2. I t shall be lawful for any mortgagor of sheep with the consent in writing of the mortgagee thereof but not without such consent to make and give a valid lien under the said first-mentioned Act so amended and perpetuated as aforesaid on the next ensuing clip of the wool of such sheep.
