14742 SUGAR. Liens on Crops of Sugar Cane Act, Etc., Act. 24 GEO. V. No. 4, The Principal Act and this Act may collectively be cited as "The Liens on Crops of Sugar Cane Acts, 1931 to 1933." Amendments of the Principal Act. Amendment 2. The following provision is added to section of 8. 16. sixteen as follows : - " Notwithstanding anything in this Act or in any other Act or law to the contrarY, where any Cane Pest Board constituted under the provisions of *'" The Sugar Experiment Stations Acts, 1900 to 1923," shall supply to any owner of a crop any fumigant for the purposes of the control of cane pests, the cost of such fumigant so supplied by such Board and the cost to the Board of the application thereof shall be and constitute a first charge against the crop in priority to any lien duly registered under and in accordance with the provisions of this Act: Provided always that, if such first charge against any such crop as aforesaid shall be disputed byany person, a certificate in writing of the Board concerned given to such person or to any court or tribunal to which such dispute or any question relating to such sugar-cane or the proceeds thereof, or the disposal of either of them, may have been referred according to law- (a) That such fumigation was considered essential according to the opinion of a competent officer appointed by the Board in that behalf ; and (b) That the work of fumigation was carried out under the direct supervision of such competent officer of the Board concerned; and (c) Stating the amount of the cost of such fumigant so supplied by such Board and of the cost to the Board of the application thereof, shall conclusively establish the first charge of the Board as aforesaid for the amount so stated: Provided further, that the above provisions shall, extend and apply only to such liens aforesaid as are registered after the passing of t" The Liens on Orops of Sugar Oane Act Amendment Act of 1933." Subsection two of section twenty-three is Amendments amended by inserting after the words "The provisions of s. 23. of this Act" the words "relating to registration"; also by adding to the said subsection the following words, namely; "and for the purpose of determining priority under this Act between or among liens, registration under the said *" The State Securities Reaistration Act of 1925" of any such lien as is first mentioned in this subsection shall have the same effect as and be deemed to be registration under this Act." The amendments made to the said subsection shall Retrospec· be deemed to have been made in the Principal Act tivity. on the fourteenth day of January, one thousand nine hundred and thirty-two, and to that extent this Act shall have retrospective operation. 4. The following section is added to the Principal Act, namely;--- " l24.] The Governor in Council, with the concur- Rules of rence of any two or more of the Judges of the Court. Supreme Court, may from time to time by Order in Council published in the Gazette make such Rules of Court as may be necessary or convenient to give full effect to the objects and purposes of this Act, and the provisions of section eleven of t" The Supreme Court Act of 1921" shall, mutatis mutandis, apply and extend accordingly.
