An Act to amend sections thirty-eight and thirty-

nine of the Licensing Act, 1911-1951.

[Assented to 9th January, 1954.]

BE it enacted, by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title

and citation.

1. (1) This Act may be cited as the Licensing

Act Amendment Act, 1953.

In this Act the Licensing Act, 1911-1951,

Act No. 32 of 1911 as reprinted with amendments to and including Act No. 30 of 1949 incorporated pursuant to the provisions of the Amendments Incorporation Act, 1938, and as further amended by Acts Nos. 36 of 1951, 49 of 1951 and 59 of 1951,

is referred to as the principal Act.

(3) The principal Act, as amended by this Act,

may be cited as the Licensing Act, 1911-1953.

2. Section thirty-eight of the principal Act is

amended by

(a)

deleting the word "any" firstly occuring in line two of subsection (1);

(b)

deleting the words "wholly of spirits, or of wine, or of beer, or of some other kind of liquor" in lines one, two and three of the subsection (2) and substituting the words "of spirits, wine, beer or some other kind of liquor, or one or more of such kinds of liquor".

3. Section thirty-nine of the principal Act is

amended.

amended by deleting the words "and kind" in lines

three and four of paragraph (b) of subsection (1).
