No. 30 of 1949.
AN ACT to amend sections one hundred and forty-seven and one hundred and forty-nine of the Licensing Act, 1911-1948.
[Assented to 22nd October, 1949.]
BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
This Act may be cited as the Licensing Act Amend- ment Act,1949, and shall be read as one with the Licens- ing Act, 1911-1948 (Act No. '32 of 1911, as reprinted with amendments up to and including Act No. 35 of 1923, incorporated in the appendix to the Sessional Volume of the Statutes for the year 1928 and further amended by Acts Nos. 27 of 1928, 41 of 1928, 23 of 1929, 30 of 1930, 27 of 1931, 36 of 1931, 49 of 1931, '35 of 1934, 34 of 1939, '35 of 1944, 43 of 1946, 47 of 1947 and 14 of 1948), hereinafter referred to as the principal Act.

Section one hundred and forty-seven of the prin- cipal Act is amended--
of 8. 147
| (a) | by inserting after the word "shall" in line two |
of subsection (1) the word "knowingly";
(b) by deleting in line five of subsection (1) the
word "apparently";
| (c) | by deleting subsections (2) and (3) ; |
| (d) | by inserting a new subsection to stand as sub- |
section (2) as follows :—
(2) Any person who on licensed premises
or on a highway or place adjacent to
licensed premises knowingly supplies or
causes or permits to be supplied any liquor to any person under the age of twenty-one years, commits an offence.
Penalty—Twenty pounds.

| (a) | by deleting in lines one and two the words "who by falsely representing himself to be over the age of twenty-one years" and sub- stituting therefor the words "under the age of twenty-one years who"; |
(b) by deleting in line four the words "Five pounds" and substituting therefor the words "Twenty pounds".
