Variation to Licence Area Plan for Wagga Wagga Radio – No 1 of 2006
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications & Media Authority varies the Licence Area Plan for Wagga Wagga Radio determined on 6 December 2001 and varied on 24 February 2005 (the principal instrument) in the manner set out below:
The determination in the principal instrument is varied:
(a) in clause (3):
(i) to omit “Two community radio services are” and to substitute “One community radio service is”;
(ii) to omit “the services that are to be available” and to substitute “the service that is to be available”
(iii) to omit “2.2 – 2.4’ and to substitute “2.3”;
(b) in clause (4) to omit “Attachment 3.2” and to substitute “Attachments 3.2 to 3.4”; and
(c) to insert the following clause after clause (4):
“(4A) One community radio service is to be available in the area described at Attachment 4.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachments 4.2 – 4.6 to this Determination.”
Under the heading “SCHEDULES”, immediately following the determination,
(a)omit the words “Each of the Schedules sets out:” and all seven paragraphs following and marked with dot points;
(b) omit the heading “Status column” and all five paragraphs under that heading; and
(c)omit the heading “Frequency column” and all two paragraphs under that heading.
Schedules to the principal instrument are varied to:
(a) omit Schedule Two and to substitute the table headed Schedule Two in Item 2 on page three of this instrument;
(b) omit Schedule Three and to substitute the table headed Schedule Three in Item 4 on page four of this instrument;
(c) insert the table headed Schedule Four in Item 5 on page four of this instrument after Schedule Three; and
(d) in Schedule One, omit column 2 including the heading “Status” and all text appearing below.
(4) The attachments to the principal instrument are varied to:
(a) omit Attachment 2.1 of the principal instrument and to substitute Attachment 2.1 of this instrument;
(b) omit Attachments 2.2 and 2.4 of the principal instrument;
(c) omit Attachment 3.1 of the principal instrument and to substitute Attachment 3.1 of this instrument;
(d) insert Attachments 3.3 and 3.4 of this instrument after Attachment 3.2 of the principal instrument; and
(e) insert Attachments 4.1, 4.2, 4.3, 4.4, 4.5 and 4.6 of this instrument after Attachment 3.4 of the principal instrument.
