Variation to Licence Area Plan for Spencer Gulf North Radio – No. 1 of 2009

Under subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Spencer Gulf North Radio determined on 6 December 2001 and varied on 3 July 2003 (the principal instrument) in the manner set out below:

In the determination in the principal instrument:

(a)number each of the paragraphs in the Determination consecutively as clauses (1), (2), (3), (4) and (5); and

(b) insert the following clauses after clause (5):

“(6) One community radio service is to be available in the area described at Attachment 5.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specification, of the service that is to be available in the area described at Attachment 5.1 are set out in Schedule Five and Attachments 5.2 – 5.3 to this Determination.

(7) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time.”

Immediately following the determination, in the principal instrument:

(a)omit the heading “SCHEDULES”;

(b)omit the words “Each of the Schedules sets out:”; and

(c)omit all nine paragraphs marked with dot points; and

(d)omit the text under “Status Column” including the heading; and

(e)omit the text under “Frequency Column” including the heading.

In the schedules to the principal instrument:

(a)omit Schedules One, Two, Three and Four and substitute Schedules One, Two, Three and Four of this instrument;

(b)insert Schedule Five of this instrument after Schedule Four.

In the attachments to the principal instrument:

(a)omit Attachment 1.1 and substitute Attachment 1.1 of this instrument;

(b)omit Attachment 1.11;

(c)omit Attachments 2.1, 3.1 and 4.1 and substitute Attachments 2.1, 3.1 and 4.1 of this instrument; and

(d)insert Attachments 5.1, 5.2 and 5.3 of this instrument after Attachment 4.2.
