VARIATION TO LICENCE AREA PLAN FOR REGIONAL VICTORIA TELEVISION – NO 1 OF 2006
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Regional Victoria Television determined on 23 October 2003 (the principal instrument) in the manner set out below:
The determination in the principal instrument is varied to:
(a) omit the third, fourth and sixth paragraphs;
(b) number each of the paragraphs in the determination consecutively as clauses (1), (2), (3) and (4);
(c) in clause (2):
(i) omit the words “One national television broadcasting service is to be available in the area described at Attachment A” and substitute the words “Two national television and two commercial television broadcasting services are to be available in the area described at Attachment 1.1”;
(ii) omit the words “Attachment A” and substitute the words and number “Attachment 1.1”; and
(iii) omit the words and numbers “Attachments 1.1 to 1.53” and substitute the words and numbers “Attachments 1.2 to 1.176”.
(d) in clause (3)
(i) omit the words “Attachment B” and substitute the words and number “Attachment 2.1”; and
(ii) omit the words and numbers “Attachments 4.1 to 4.53” and substitute the words and numbers “Attachments 2.2 to 2.33”.
(e) in clause (4)
(i) omit the words “Attachment C” and substitute the words and number “Attachment 3.1”;
(ii) omit the words and numbers “Attachments 6.1 to 6.53” and substitute the words and numbers “Attachments 3.2 to 3.15”.
(f) Insert the following clause after clause (4):
“(5) A reference in this determination to a schedule or an attachment includes a reference to a schedule as amended from time to time.”
Under the heading “SCHEDULES”, immediately following the determination;
(a) omit the words “The Schedule sets out:”;
(b) omit all eight paragraphs marked with dot points;
(c) omit the heading “Status Column” and the five paragraphs following that heading; and
(d) omit the heading “Attachment Numbers” and the two paragraphs immediately following that heading.
Schedules to the principle instrument are varied to:
(a) omit Schedule One of the principal instrument and substitute the table headed Schedule One in item 2 on page 12 of this instrument;
(b) omit Schedule Two of the principal instrument and substitute the table headed Schedule Two in item 3 on page 17 of this instrument; and
(c) omit Schedule Three of the principal instrument and substitute the table headed Schedule Three in item 4 on page 18 of this instrument.
Omit all attachments to the principal instrument and substitute all attachments to this instrument.
