Variation to Licence Area Plan for Perth Radio – No. 1 of 2009
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992 (the BSA), the Australian Communications and Media Authority varies the Licence Area Plan for Perth Radio determined on 11 October 2001 and varied on 19 September 2002, 22 October 2002 and 16 November 2006 (the principal instrument) in the manner set out below:
Clause (2) of the Determination in the principal instrument is varied to omit the words “Attachments 1.2 – 1.30” and substitute the words “Attachments 1.2 – 1.34”;
The schedules to the principal instrument are varied to omit Schedule One of the principal instrument and substitute Schedule One of this instrument;
The attachments to the principal instrument are varied to:
(a) omit Attachment 1.1 of the principal instrument and substitute Attachment 1.1 of this instrument;
(b) omit Attachment 1.8 of the principal instrument;
(c) omit Attachment 1.14 of the principal instrument and substitute Attachment 1.14 of this instrument;
(d) omit Attachment 1.22 of the principal instrument;
(e) omit Attachment 1.25 of the principal instrument and substitute Attachment 1.25 of this instrument; and
(f) after Attachment 1.30 of the principal instrument insert Attachments 1.33 and 1.34 of this instrument into the principal instrument.

Special Conditions :-
This service is required to protect the reception of ABSW5 Bunbury. Implementation of the proposed specification is subject to clearance of ABSW5 Bunbury or test transmissions conducted by the licensee, confirming to the ACMA’s satisfaction that operation in accordance with the proposed specification does not cause interference to the reception of ABSW5 in the Mandurah/Pinjarra area where an alternative television channel is not available. Should interference to the reception of ABSW5 Bunbury occur in the Mandurah/Pinjarra area, the licensee will be required to reduce power and/or transmit a singular (vertically) polarised signal to eliminate the interference, or if tests reveal interference then the licensee is responsible for alleviation of the interference.
This service also has potential to cause adjacent channel interference to the retransmission service ABCFM on 98.3 MHz at Jurien. Should interference to the reception of 6ABCFM occur, the licensee is responsible for alleviation of the interference.
