Variation to Licence Area Plan for Nowra Radio – No. 1 of 2008
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992 (the BSA), the Australian Communications and Media Authority varies the Licence Area Plan for Nowra Radio determined on 12 August 1999 (the principal instrument) in the manner set out below:
(1)The Determination in the principal instrument is varied to:
(a)number each of the paragraphs in the determination consecutively as clauses (1), (2), (3), (4), (5), (6), (7), and (8);
(b)in clause (3), omit the words “Attachments 1.3 – 1.7” and substitute the words “Attachments 1.3, 1.5 – 1.7, 1.11 and 1.12”;
(c)omit clause (5) and substitute the following:
“(5) Two community radio broadcasting services are to be available in the area described at Attachment 2.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 and 2.3 to this Determination.”;
(d)omit clause (6) and renumber clauses (7) and (8) as clauses (6) and (7) respectively;
(e)insert the following clauses at the end of the determination:
“(8) One community radio broadcasting service is to be available in the area described at Attachment 6.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 6.1 are set out in Schedule Six and Attachment 6.2 to this Determination.
(9) A reference in this Determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time.”
(2)Immediately following the determination, the principal instrument is varied to:
(a) omit the heading “SCHEDULES”;
(b) omit the words “Each of the Schedules sets out:”;
(c) omit all eight paragraphs marked with dot points and the paragraph marked with the hash mark;
(d) omit the heading “Status Column” and the seven lines of text immediately following that heading;
(e) omit the heading “Frequency Column” and the paragraph immediately following that heading.
(3) The schedules to the principal instrument are varied to:
(a) omit Schedule One of the principal instrument and substitute Schedule One of this instrument;
(b) omit Schedule Two of the principal instrument and substitute Schedule Two of this instrument;
(c) omit Schedule Three of the principal instrument;
(d) omit the “Status” column from Schedule Four of the principal instrument;
(e) omit the “Status” column from Schedule Five of the principal instrument;
(f) insert Schedule Six of this instrument.
(4) Attachments to the principal instrument are varied to:
(a) omit Attachment 1.1 of the principal instrument and substitute Attachment 1.1 of this instrument;
(b) omit Attachment 1.4 of the principal instrument.
(c) insert Attachment 1.11 of this instrument;
(d) insert Attachment 1.12 of this instrument;
(e) omit Attachment 2.1 of the principal instrument and substitute Attachment 2.1 of this instrument;
(f) insert Attachment 2.3 of this instrument immediately after Attachment 2.2 of the principal instrument;
(g) omit Attachment 3.1 of the principal instrument;
(h) omit Attachment 3.2 of the principal instrument;
(i) omit Attachment 4.1 of the principal instrument and substitute Attachment 4.1 of this instrument;
(j) omit Attachment 5.1 of the principal instrument and substitute Attachment 5.1 of this instrument;
(k) insert Attachment 6.1 of this instrument; and
(k) insert Attachment 6.2 of this instrument.
