VARIATION TO LICENCE AREA PLAN FOR LAUNCESTON RADIO – No 1 of 2005

On 24 March 2005, pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Broadcasting Authority varied the Licence Area Plan for Launceston Radio determined on 13 December 2001 (the principal instrument) in the manner set out below.

  1. The determination in the principal instrument is varied to:

(a) number each of the paragraphs in the determination consecutively as clauses (1), (2), (3), (4) and (5); and

(b) in clause (2), omit the number “1.8” and to substitute the number “1.11”; and

(c) insert the following clause after clause (5):

“(6) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time”.

  1. Page 2 of the principal instrument is omitted.

  1. Schedules to the principal instrument are varied to:

(a) omit Schedule One of the principal instrument and to substitute the table headed Schedule One in item 2 on page 5 of this instrument; and

(b) omit column 2 from Schedules Two, Three and Four, including the heading and all text.

  1. Attachments to the principal instrument are varied to:

(a) insert Attachment 1.10 of this instrument into the principal instrument after Attachment 1.2;

(b) insert Attachment 1.9 of this instrument into the principal instrument after Attachment 1.8;

(c) insert Attachment 1.11 of this instrument into the principal instrument after Attachment 1.7;

(d) omit Attachment 1.2 of the principal instrument and to substitute Attachment 1.2 of this instrument;

(e)  omit Attachment 1.7 of the principal instrument and to substitute Attachment 1.7 of this instrument;

(f) omit Attachment 1.8 of the principal instrument and to substitute Attachment 1.8 of this instrument;

(g) omit the following special condition at the end of Attachment 1.5 of the principal instrument:

Special condition:

This service is required to transmit a singular (vertically) polarised signal until the Band II clearance of ABNT3 North East Tasmania.

Should interference to the reception of ABNT4 Savage River occur the licensee will be required to reduce power and/or transmit a singular (vertically) polarised signal to eliminate the interference.”.

(h) omit Attachment 1.6 of the principal instrument and to substitute Attachment 1.6 of this instrument;

(i) omit Attachment 1.1 of the principal instrument and to substitute Attachment 1.1 of this instrument;

(j) omit Attachment 2.1 of the principal instrument and to substitute Attachment 2.1 of this instrument;

(k) omit Attachment 3.1 of the principal instrument and to substitute Attachment 3.1 of this instrument; and

(l) omit Attachment 4.1 of the principal instrument and to substitute Attachment 4.1 of this instrument.

  1. The instrument commences on the date of its determination by the Australian Broadcasting Authority.
