Variation to Licence Area Plan for Kalgoorlie Radio – No.1 of 2010
Enabling legislation
The Australian Communications and Media Authority makes this instrument under subsection 26(2) of the Broadcasting Services Act 1992.
Name of Instrument
This instrument is the Variation to Licence Area Plan for Kalgoorlie Radio – No. 1 of 2010.
Commencement
This instrument commences the day after it is registered.
Note: An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (FRLI) in electronic form: see the Legislative Instruments Act 2003, s4 (definition of register). The FRLI may be accessed at type="1">
Variation
The Licence Area Plan for Kalgoorlie Radio determined by the Australian Broadcasting Authority on 26 September 1996 is varied as follows:
a)in the heading on the cover page – omit the words “SEPTEMBER 1996”;
b)number each of the paragraphs in the determination consecutively as clauses (1), (2), (3) and (4);
c)in clause (2)
(i)omit the words “Nine national radio broadcasting services, two commercial radio services and one open narrowcasting radio service” and substitute the words “Ten national radio broadcasting services, two commercial radio broadcasting services and three open narrowcasting radio services”; and
(ii)omit the words “Attachments 1.2 - 1.18” and substitute the words “Attachments 1.2 - 1.21”;
d)omit clause (3) and substitute the following clause:
(3) Two community radio broadcasting services for Kalgoorlie are to be available in the area described at Attachment 2.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 and 2.3.”
e)omit clause (4) from the determination;
f) insert the following clause after clause (3):
“(4) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time.”;
g)immediately following the determination:
(i)omit the heading “SCHEDULES”;
(ii)omit the words “Each of the Schedules sets out:”, and all six paragraphs marked with dot points that follow;
h)omit Schedule One and Schedule Two and substitute Schedule One and Schedule Two of this instrument;
i)omit Schedule Three; and
j)omit all the Attachments and substitute in numerical order all the Attachments to this instrument;
