Variation to Licence Area Plan for Bendigo Radio – No. 1 of 2009
Under subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Bendigo Radio determined on 8 August 1997 and varied on 7 October 1999 and 22 May 2008 (the principal instrument) in the manner set out below:
The determination in the principal instrument as follows:
(a)in clause (2):
(i)omit the words “Three national” and to substitute the words “Four national”;
(ii)omit the words “Attachments 1.2 – 1.7” and substitute the words “Attachments 1.2 – 1.8”;
(b) omit clause (4) and substitute:
“(4) One community radio broadcasting service is to be available in the area described at Attachment 3.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachment 3.3 to this Determination.”;
(c)omit clause (9) and substitute the following clauses:
“(9) One community radio broadcasting service is to be available in the area described at Attachment 8.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 8.1 is set out in Schedule Eight and Attachment 8.2 to this Determination.
(10) Two community radio broadcasting services are to be available in the area described at Attachment 9.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 9.1 is set out in Schedule Nine and Attachments 9.2 - 9.3 to this Determination.
(11) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time.”.
The Schedules to the principal instrument are varied to:
(a)omit Schedule One and Schedule Three and substitute Schedules One and Schedule Three of this instrument;
(b)insert Schedule Eight and Schedule Nine of this instrument after Schedule Seven of the principal instrument.
The Attachments to the principal instrument are varied to:
(a)insert Attachment 1.8 of this instrument after Attachment 1.7 of the principal instrument.
(b)omit Attachment 3.2 of the principal instrument;
(c)insert Attachments 8.1, 8.2, 9.1, 9.2 and 9.3 of this instrument after Attachment 7.2 of the principal instrument.
