Variation to Licence Area Plan for Bendigo Radio – No. 1 of 2008
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Bendigo Radio determined on 8 August 1997 (the principal instrument) in the manner set out below:
(1)The determination in the principal instrument is varied to:
(a) number each of the paragraphs in the determination consecutively as clauses (1), (2), (3), (4), (5), (6) and (7);
(b) omit the words “three commercial” and to substitute the words “two commercial” in clause (2);
(c) insert the following clauses after clause (7):
“(8) One community radio broadcasting service is to be available in the area described at Attachment 7.1 to this determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 7.1 is set out in Schedule Seven and Attachment 7.2.
(9) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time.”
(2)Immediately following the determination:
(a) omit the heading “SCHEDULES”;
(b) omit the words “Each of the Schedules sets out”; and
(c) omit all six paragraphs marked with dot points.
(3) The schedules to the principal instrument are varied to:
(a) omit Schedule Five of the principal instrument and substitute Schedule Five of this instrument; and
(b) following Schedule Six of the principal instrument, insert Schedule Seven of this instrument.
(4) Attachments to the principal instrument are varied to:
(a) omit Attachment 1.1, of the principal instrument and substitute Attachment 1.1 of this instrument;
(b) omit Attachment 1.2 of the principal instrument and substitute Attachment 1.2 of this instrument;
(c) omit Attachment 1.3 of the principal instrument and substitute Attachment 1.3 of this instrument;
(d) omit Attachment 1.4 of the principal instrument and substitute Attachment 1.4 of this instrument;
(e) omit Attachment 1.7 of the principal instrument and substitute Attachment 1.7 of this instrument;
(f) omit Attachment 2.1 of the principal instrument and substitute Attachment 2.1 of this instrument;
(g) omit Attachment 3.1 of the principal instrument and substitute Attachment 3.1 of this instrument;
(h) omit Attachment 4.1 of the principal instrument and substitute Attachment 4.1 of this instrument;
(i) omit Attachment 4.2 of the principal instrument and substitute Attachment 4.2 of this instrument;
(j) omit Attachment 4.3 of the principal instrument and substitute Attachment 4.3 of this instrument;
(k) omit Attachment 5.1 of the principal instrument and substitute Attachment 5.1 of this instrument;
(l) omit Attachment 5.2 of the principal instrument and substitute Attachment 5.2 of this instrument;
(m) omit Attachment 6.1 of the principal instrument and substitute Attachment 6.1 of this instrument;
(n) insert Attachments 7.1 and 7.2 of this instrument after Attachment 6.2.
