VARIATION TO LICENCE AREA PLAN FOR ALBURY RADIO – No 1 of 2005
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Broadcasting Authority varies the licence area plan for Albury Radio determined on 15 September 1997 (the principal instrument) in the manner set out below:
The determination in the principal instrument is varied to:
(a) number each of the paragraphs in the determination consecutively as clauses (1), (2), (3), (4), (5), (6), (7) and (8);
(b) to omit “(Albury)” wherever appearing in clauses (2), (3), (4) and (5),
(c) in clause (6),
(i) to omit the words “One community radio broadcasting service is to be available” and to substitute the words “Two community radio broadcasting services are to be available”;
(ii) to omit “(Corryong)”;
(iii) to omit the word and numbers “Attachment 3.2” and to substitute the word and numbers “Attachments 3.2 to 3.5”;
(d) to omit “(Omeo)” in clause (7);
(e) to omit “(Walwa/Jingellic)” in clause (8);
(f) to insert the following clause after clause (8):
“(9) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time”.
Page 3 of the principal instrument is omitted.
Schedules to the principal instrument are varied to:
(a) omit Schedule One of the principal instrument and to substitute the table headed Schedule One in Item 2 on pages 6 and 7 of this instrument;
(b) omit Schedule Three of the principal instrument and to substitute the table headed Schedule Three in Item 3 on page 7 of this instrument; and
(c) omit Schedule Five of the principal instrument and to substitute the table headed Schedule Five in Item 4 on page 7 of this instrument.
(4) Attachments to the principal instrument are varied to:
(a) omit Attachment 1.1 of the principal instrument and to substitute Attachment 1.1 of this instrument;
(b) omit Attachment 1.2 of the principal instrument and to substitute Attachment 1.2 of this instrument;
(c) omit Attachment 1.15 of the principal instrument and to substitute Attachment 1.15 of this instrument;
(d) insert Attachment 1.28 of this instrument into the principal instrument after Attachment 1.15;
(e) omit Attachment 1.16 of the principal instrument and to substitute Attachment 1.16 of this instrument;
(f) omit Attachment 1.19 of the principal instrument and to substitute Attachment 1.19 of this instrument;
(g) insert Attachment 1.29 of this instrument into the principal instrument after Attachment 1.19;

(l) insert Attachments 3.3, 3.4 and 3.5 of this instrument into the principal instrument after Attachment 3.2;
(m) omit Attachment 4.1 of the principal instrument and to substitute Attachment 4.1 of this instrument;
(n) omit Attachment 5.1 of the principal instrument and to substitute Attachment 5.1 of this instrument;
(o) omit Attachment 5.2 of the principal instrument and to substitute Attachment 5.2 of this instrument.
