LIBRARY (AMENDMENT) ACT.
Act No. 29, 1952.
An Act to amend the Library Act, 1939-1948,
in certain respects; and for purposes
connected therewith. [Assented to, 21st October, 1952.]
| BE it enacted by the Queen's Most Excellent Majesty, by find with the advice and consent of the Legis | lative Council and Legislative Assembly of New South |
| Wales in Parliament assembled, and by the authority of the same, as follows:— | |
| 1. (1) This Act may be cited as the "Library (Amendment) Act, 1952". | |
| (2) The Library Act, 1939, as amended by subse quent Acts and by this Act, may be cited as the Library Act, 1939-1952. | |
| (3) This Act shall be deemed to have commenced upon the first day of January, one thousand nine hundred and fifty-two. | |
| 2 . The Library Act, 1939-1948, is amended by omitting subsections four and five of section thirteen and by inserting in lieu thereof the following subsection:— |
(b)
(4) Where a council is eligible for subsidy under this section the subsidy payable to the council in respect of any year shall be—
(a)
an amount equal to one-half of the total amount expended by the council on libraries and library services in that year from—
(i) rate income, and
(ii) any advance against subsidy made by the Minister to the council in respect of that year; or
(b)
an amount equivalent to one shilling and sixpence for each person resident within the area of the council,
whichever is the less.
An advance against subsidy may be made by the Minister to a council in any year in respect of which the Minister considers the council would, on the basis of the council's estimated expenditure on libraries and library services in that year from rate income, be eligible for subsidy under this section.
Any such advance shall be payable upon such conditions and at such times as the Minister may determine.
