Libraries Amendment Act 2000

An Act to amend the Libraries Act 1984

[Royal Assent 14 July 2000]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Libraries Amendment Act 2000 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Libraries Act 1984 is referred to as the Principal Act. 4Section 3 amended (Interpretation) Section 3 of the Principal Act is amended as follows: (a) by omitting the definition of Advisory Committee ; (b) by omitting the definitions of Northern Library Advisory Committee and North-Western Library Advisory Committee ; (c) by omitting the definition of Southern Library Advisory Committee . 5Section 8 amended (Consultation by Secretary) Section 8 of the Principal Act is amended by omitting paragraph (b) . 6Section 9A amended (Minister may issue guidelines for charging library fees) Section 9A(3) of the Principal Act is amended by omitting "and each Advisory Committee". 7Part III: Heading amended Part III of the Principal Act is amended by omitting "AND ADVISORY COMMITTEES" from the heading to that Part. 8Section 11 amended (Tasmanian Library Advisory Board) Section 11 of the Principal Act is amended as follows: (a) by omitting paragraph (b) from subsection (2) and substituting the following paragraph: (b) 4 persons nominated by the Minister from a list of names representing a mix of urban and rural interests submitted by the Local Government Association of Tasmania of whom  – (i) at least one is from the northern area; and (ii) at least one is from the north-western area; and (iii) at least one is from the southern area; and (b) by omitting paragraphs (e) , (f) and (g) from subsection (2) and substituting the following paragraphs: (e) a person nominated by the Minister from the northern area to represent the interests of users from that area; and (f) a person nominated by the Minister from the north-western area to represent the interests of users from that area; and (g) a person nominated by the Minister from the southern area to represent the interests of users from that area. (c) by omitting from subsection (3) " subsection (2) (a) , (b) and (c) " and substituting " subsection (2)(a) , (b) , (c) , (e) , (f) and (g) "; (d) by omitting subsection (7A) and substituting the following subsection: (7A)  The membership of the Board is to reflect a mix of urban and rural interests. 9Section 12 amended (Functions of Board) Section 12(a) of the Principal Act is amended by omitting "or an Advisory Committee". 10Sections 14 and 15 repealedSections 14 and 15 of the Principal Act are repealed. 11Schedule 2 repealed Schedule 2 to the Principal Act is repealed.
