260 Q11M MIMi4 ANNO VICESIMO OCTAVO ELIZABETHAE SECUNDAE REGINAE No. 30 of 1979 An Act to amend the Libraries Act 1943-1977 in certain particulars and for other purposes [ASSENTED TO 8TH JUNE, 1979] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Libraries Act Amendment Act 1979. (2) In this Act the Libraries Act 1943-1977 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Libraries Act 1943-1979.
Libraries Act Amendment Act 1979, No. 30 261 2. Validation of regulations . The regulations purporting to have been made in pursuance of The Libraries Acts, 1943 to 1949 on 5 May, 1949 and published in the Gazette on 7 May, 1949 at page 1884 shall notwithstanding any defect therein, or the absence of any authority for the making thereof be deemed to have been validly made under those Acts and on the commencement of this Act shall be as valid and effectual as if made under the authority of the Libraries Act 1943-1979. 3. Validation of appointments . It is declared that all appointments made to the Library Board of Queensland before the commencement of this Act were lawfully and effectively made. 4. Validation of certain payments . It is declared that- (a) all payments of allowances made to members and to persons purporting to be members of the Library Board of Queensland before the commencement of this Act were lawfully made; (b) the persons to whom payments referred to in paragraph (a) have been made are and always were lawfully entitled to accept the moneys paid to them and to retain those moneys. 5. Amendment of s. 5. Section 5 of the Principal Act is amended by omitting subsection (4) and substituting the following subsection:- " (4) Regulations may be made relating to the members of any subsequent Board providing for all or any of the following matters:- (a) the mode of their appointment (including whether such appointment is to be made following an election or on nomination); (b) the tenure of the appointment; (c) such other acts, matters and things as may be prescribed. Every subsequent Board shall consist of such number of persons as are appointed to it from time to time. The Governor in- Council shall designate one of the members of the Board as Chairman.". 6. New s. 5A. The Principal Act is amended by inserting after section 5 the following section:- 5A. Allowances. Such allowances as are prescribed shall be paid to every member of, the Board save to a member who is an officer of the Public Service of Queensland in respect of his attendance at a meeting of the Board during his ordinary hours of duty as such an officer.". 7. Payment of allowances . Allowances may be paid to any member of the Library Board of Queensland in accordance with the regulations made pursuant to the provisions' of the Libraries Act 1943-1979 in respect of his attendance at any meeting thereof held after 8 November, 1978:
262 Libraries Act Amendment Act 1979, No. 30 Provided that no allowance shall be paid to any member who was at the time an officer of the Public Service of Queensland in respect of his attendance at any such meeting during his ordinary hours of duty as such an officer.
