KIRBY J:   This was an application for special leave to appeal which was heard in Canberra by video link to Brisbane on 8 December 2006 by a Court constituted by Justices Hayne, Callinan and myself.  At the conclusion of the hearing of the application the matter was stood over to be listed for mention before Justice Callinan in Brisbane.  Justice Callinan called the matter over before him today at 11 o’clock in Brisbane and the matter was considered by his Honour with a view to the clarification of the grounds of appeal, were special leave granted.

Justice Callinan has reported to me the fact that he is satisfied that amended grounds of appeal have been placed in a proper form and that they will be filed in due course.  I have reported that to Justice Hayne and what is now to be done by Justices Callinan and myself is done on behalf of the Court as it was originally constituted hearing the application for special leave.

The Court grants special leave in this matter.  It orders that the amended draft notice of appeal be filed by the appellant before 10 January 2007 at the Brisbane Registry.  It notes that the matter is a one‑day case and will be heard by a Court constituted by five Justices.  Accordingly, the order of the Court is special leave to appeal is granted.
