  1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Maxwell P and Beach JA) refusing leave to appeal from a decision of the County Court of Victoria (Judge Carlin) refusing to stay permanently a trial in that Court. The applicant was indicted on one charge of using a carriage service to transmit an indecent communication to a person he believed to be under 16 years of age, contrary to s 474.27A(1) of the Criminal Code (Cth).

  2. There is no reason to doubt the correctness of the decision of the Court of Appeal. Accordingly, special leave should be refused.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
