1  Name

This is the Legislative Instruments (Deferral of Sunsetting—Motor Vehicle Standards Instruments) Certificate 2016.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under paragraph 51(1)(c) of the Legislative Instruments Act 2003.

4  Definitions

In this instrument:

Act means the Legislative Instruments Act 2003.

5  Statement of reasons for issue of certificate

For paragraph 51(2)(a) of the Act, this section sets out the statement of the reasons for the issue of this certificate.

Statement of reasons

I am satisfied that the instruments mentioned in section 6 (the instruments) would, apart from the operation of Part 6 of the Act, be likely to cease to be in force within 12 months after the sunsetting day for the instruments.

The instruments are made under the Motor Vehicle Standards Act 1989, and as a result of a review of that Act, changes to the definition of road vehicle and the registered automotive workshop scheme are under consideration, requiring the instruments to be repealed and remade.

The instruments are due to sunset on 1 October 2016. A 12 month deferral of the sunsetting day will likely avoid the need to remake them in their current form for the short period before replacement instruments are made and commence.

6  Deferral of sunsetting of legislative instruments

The following legislative instruments, for which the sunsetting day is 1 October 2016, are taken to cease to be in force under section 51 of the Act on 1 October 2017:

(a)  the Motor Vehicle Standards (Approval to Place Used Import Plates) Guidelines 2006 (No. 1);

(b)  the Motor Vehicle Standards (Placement of Used Import Plates) Determination 2004 (No. 1);

(c)  the Motor Vehicle Standards (Registered Automotive Workshops — Fit and Proper Persons) Determination 2002;

(d)  the Motor Vehicle Standards (Road Vehicles) Determination 2003;

(e)  the Motor Vehicle Standards (Used Imported Vehicle Report) Determination 2006 (No. 1).

7  Repeal of this instrument

This instrument is repealed on 2 October 2017.
