An Act to amend the Legislative Assembly (Members' Staff) Act 1989
The Legislative Assembly for the Australian Capital Territory enacts as follows:
Name of Act
This Act is the Legislative Assembly (Members' Staff) Amendment Act 2008.
Commencement
(1)The following provisions commence on the day after the day the result of the 2008 general election of members of the Assembly is declared:
· section 3;
· section 5;
· section 7;
· section 8;
· section 9.
(2)The remaining provisions commence on the first sitting day after the day the result of the 2008 general election of members of the Assembly is declared.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This Act amends the Legislative Assembly (Members' Staff) Act 1989.
Office-holders may employ staff
New section 5 (1A)insert
(1A)However, an office-holder must not employ a person who is a family member of the office-holder.
Members may employ staff
New section 10 (1A)insert
(1A)However, a member of the Assembly must not employ a person who is a family member of the member.
Office-holders may engage consultants and contractors
New section 17 (1A)insert
(1A)However, an office-holder must not engage a consultant or contractor who—
(a)if the consultant or contractor is an individual—is a family member of the office-holder; or
(b)if the consultant or contractor is a corporation—has a director or other officer who is a family member of the office-holder.
Members may engage consultants and contractors
New section 20 (1A)insert
(1A)However, a member of the Assembly must not engage a consultant or contractor who—
(a)if the consultant or contractor is an individual—is a family member of the member; or
(b)if the consultant or contractor is a corporation—has a director or other officer who is a family member of the member.

Dictionary, new definition of family member
insert
family member, of a person, means—
(a)a domestic partner of the person; or
(b) a parent or step-parent of the person; or
(c) a parent or step-parent of the person’s domestic partner; or
(d) a child or step-child of the person; or
(e) a child or step-child of the person’s domestic partner; or
(f) a brother, sister, half-brother or half-sister of the person; or
(g) a grandparent of the person; or
(h) an uncle, aunt or cousin of the person.
