An Act to amend the Legislative Assembly (Members’ Staff) Act 1989

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Legislative Assembly (Members’ Staff) (Amendment) Act 1997.

Commencement

2.  This Act commences on the day on which it is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Legislative Assembly (Members’ Staff) Act 1989.1

Office-holders may employ staff

4.  Section 5 of the Principal Act is amended by inserting in subsection (2) “, in writing,” after “approved” and “determined”.

Members may employ staff

5.  Section 10 of the Principal Act is amended by inserting in subsection (2) “, in writing,” after “approved” and “determined”.

Terms and conditions of employment

6. Section 11 of the Principal Act is amended by omitting subsection (4).

Insertion

7. Before section 14 of the Principal Act the following section is inserted in Part IV:

Disallowable instruments

“13D.  An instrument referred to in section 4 or in subsection 5 (2), 6 (2), 8 (6), 10 (2), 11 (2) or 13 (5) is a disallowable instrument for the purposes of section 10 of the Subordinate Laws Act 1989.”.
