1 Name
This instrument is the Legislation (Deferral of Sunsetting—Veterans’ Entitlements Treatment (Australian Centre for Posttraumatic Mental Health) Determination) Certificate 2018.
2 Commencement
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This instrument is made under paragraph 51(1)(c) of the Legislation Act 2003.
4 Definitions
In this instrument:
Determination means the Veterans’ Entitlements Treatment (Australian Centre for Posttraumatic Mental Health) Determination 2007.
Legislation Act means the Legislation Act 2003.
5 Statement of reasons for issue of certificate
For the purposes of paragraph 51(2)(a) of the Legislation Act, this section sets out the statement of the reasons for the issue of this certificate.
Statement of reasons
I am satisfied that the Determination would, apart from the operation of Part 4 of Chapter 3 of the Legislation Act, be likely to cease to be in force within 12 months after the sunsetting day for the Determination.
The Determination is made by the Repatriation Commission under section 88A of the Veterans’ Entitlements Act 1986 and provides for the funding of services related to the mental health of veterans. These services include research into mental health injuries suffered by members of the Defence Force, policy research, providing training in mental health care disciplines, and improving communication with members on mental health care matters.
These services are currently provided by the Phoenix Australia Centre for Posttraumatic Mental Health Inc (previously the Australian Centre for Posttraumatic Mental Health) in accordance with a funding agreement that will be reviewed as part of a broader review of funding arrangements for the provision of mental health services to veterans. Following that review, the Determination will be repealed and may be replaced by a further instrument made by the Repatriation Commission that reflects any new funding arrangements. The review will be completed in time for this to occur before 1 April 2019 to ensure continuity between the current and anticipated new funding arrangements.
The Determination is due to sunset on 1 April 2018. A 12 month deferral of the sunsetting day will avoid the need to remake the Determination in its current form for the short period before that review is completed.
6 Deferral of sunsetting of the Determination
The Determination, for which the sunsetting day is 1 April 2018, is taken to cease to be in force under section 51 of the Legislation Act on 1 April 2019.
7 Repeal of this instrument
This instrument is repealed at the start of 2 April 2019.
