1  Name

This instrument is the Legislation (Deferral of Sunsetting—Threat Abatement Plans) Certificate 2017.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under paragraph 51(1)(c) of the Legislation Act 2003.

4  Definitions

In this instrument:

Legislation Act means the Legislation Act 2003.

Threat Abatement Plans means both of the following:

(a) the Threat Abatement Plan for Dieback caused by the root‑rot fungus Phytophthora cinnamomi (F2007B00393);

(b) the Threat Abatement Plan 2006 for the incidental catch (or bycatch) of seabirds during oceanic longline fishing operations (F2006L02855).

5  Statement of reasons for issue of certificate

For the purposes of paragraph 51(2)(a) of the Legislation Act, this section sets out the statement of the reasons for the issue of this certificate.

Statement of reasons

I am satisfied that the Threat Abatement Plans would, apart from the operation of Part 4 of Chapter 3 of the Legislation Act, be likely to cease to be in force within 12 months after the sunsetting day for the Threat Abatement Plans.

The Threat Abatement Plans are made under the Environment Protection and Biodiversity Conservation Act 1999 which specifies a number of requirements that must be met before such a plan is made. Those requirements include obtaining and considering the advice of the Threatened Species Scientific Committee, and consulting, on such a plan.

The Department of Environment and Energy is in the process of preparing new threat abatement plans. It is intended to obtain and consider the advice of the Threatened Species Scientific Committee on the new threat abatement plans in March 2017. Following that, there will be a public consultation on the new threat abatement plans with a view to making them before 1 April 2018.

The Threat Abatement Plans are due to sunset on 1 April 2017. A 12 month deferral of the sunsetting date for the Threat Abatement Plans will avoid the need to remake them in their current form for the short period before the new threat abatement plans are made.

6  Deferral of sunsetting of the Threat Abatement Plans

The Threat Abatement Plans, for which the sunsetting day is 1 April 2017, are taken to cease to be in force under section 51 of the Legislation Act on 1 April 2018.

7  Repeal of this instrument

This instrument is repealed at the start of 2 April 2018.
