1 Name
This is the Legislation (Deferral of Sunsetting—Principles for Approving Accredited Pathology Laboratories) Certificate 2016.
2 Commencement
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This instrument is made under paragraph 51(1)(c) of the Legislation Act 2003.
4 Definitions
In this instrument:
Act means the Legislation Act 2003.
Health Minister means the Minister administering the Health Insurance Act 1973.
5 Statement of reasons for issue of certificate
For paragraph 51(2)(a) of the Act, this section sets out the statement of the reasons for the issue of this certificate.
Statement of reasons
I am satisfied that the Health Insurance (Accredited Pathology Laboratories — Approval) Principles 2002 (the Principles), made under subsection 23DNA(1) of the Health Insurance Act 1973, would, apart from the operation of Part 4 of Chapter 3 of the Act, be likely to cease to be in force within 12 months after the sunsetting day for the Principles.
The Principles are applied by the Health Minister when deciding whether to approve premises as an accredited pathology laboratory in Australia. An independent expert review of the accreditation requirements is proposed. The Department of Health will consider the recommendations of the independent expert review and anticipates that there will be some changes to the Principles as a result.
The Principles are due to sunset on 1 October 2016. A 12 month deferral of the sunsetting day for these Principles will avoid the need to remake them in their current form for the short period before new Principles are made and commence.
6 Deferral of sunsetting of the Health Insurance (Accredited Pathology Laboratories — Approval) Principles 2002
The Health Insurance (Accredited Pathology Laboratories — Approval) Principles 2002, for which the sunsetting day is 1 October 2016, are taken to cease to be in force under section 51 of the Act on 1 October 2017.
7 Repeal of this instrument
This instrument is repealed on 2 October 2017.
