Legal Profession Uniform Law Application

Amendment Regulations 2022

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Legal Profession Uniform Law
Application Amendment Regulations 2022.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Legal Profession Uniform Law
Application Regulations 2022.

4.             Regulation 42A inserted

After regulation 42 insert:

42A. Exemption from requirement to hold Australian
practising certificate for certain contract legislative
drafters (s. 127(1)(a) and (b))

(1)	This regulation applies to a contract legislative drafter
who —

(a)	is not resident in the State; and
(b)	is an Australian lawyer or is admitted, or eligible for admission, as a lawyer in any of the

following jurisdictions —

(i)      Canada (including a Province or Territory of Canada);

(ii) Ireland;

(iii) New Zealand;

(iv) has been employed as a legislative drafter, for a period or periods equivalent to 5 years, in 1 or more government legislative drafting offices in Australia or any of the jurisdictions referred to in paragraph (b).	the United Kingdom (including England Scotland);
and

(c)

(2) The contract legislative drafter is exempt from the
requirement to hold an Australian practising certificate
in respect of legal practice that is legislative drafting
work undertaken under the direction of the
Parliamentary Counsel.

(3) Without limiting subregulation (2), the Legal
Profession Uniform Law (WA) section 10 does not
apply to the contract legislative drafter in relation to
legal practice referred to in that subregulation.

5.             Regulation 43 amended

In regulation 43(1) in the definition of foreign legislative
drafter delete paragraph (d) and insert:

(d) period or periods equivalent to 5 years, in 1 or
more government legislative drafting offices in

has been employed as a legislative drafter, for a paragraph (c).

6.             Regulation 45 amended

In regulation 45 after “regulations” insert:
