An Act to amend the Legal Practitioners Act, 1898-1935, in certain respects; to validate certain matters; and for purposes connected therewith. [Assented to, 8th April, 1936/

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with, the advice and consent of the Legis- Wales in Parliament assembled, and by the authority of
the same, as follows :—

1 . (1) This Act may be cited as the "Legal Practi-

amended by this Act, may be cited as the Legal

P rac t i t i one r s Act, 1898-1936.
2. The Legal P rac t i t ione r s Act, 1898-1935, is

amended—

(a) by omitting from section three the definition of
the word " P r e s c r i b e d " and by inser t ing in lieu

thereof the following definition—

" P r e s c r i b e d , " when used in P a r t s I to V, both inclusive, and in P a r t s X and X I , of this Act, means prescr ibed by this Act or by rules of court , and when used in P a r t s V I to IX , both inclusive, of this Act, means prescr ibed by this Act or by regu­

la t ions made thereunder .
(b) by inserting in subparagraphs (vii) and (viii)
of p a r a g r a p h (b) of subsection one of section
eighty-six af ter the word " P a r t s " wherever
occurr ing the symbol " V I " ;

(c) (i) by omit t ing from subsection one of section

20A the words " s i x m o n t h s " and by inser t ­
ing in lieu thereof the words " t w e l v e
m o n t h s ' ' ;

(ii)   by omitting from the same subsection the words " t w e l v e months a f t e r " and by inser t ­ ing in lieu thereof the words "fif teen

months a f t e r " ;

(iii)   by inserting at the end of the same subsec­ t ion the words " P r o v i d e d that an appl icant who hav ing made an applicat ion under section seventeen of this Act within the per iod prescr ibed by this section has sat for but failed to pass the examinat ion within the per iod prescr ibed by this section may, on pass ing a fu r ther examinat ion held within six months of the da te of the former exam­ ination, be g ran ted a certificate to prac t i se

as a c o n v e y a n c e r " ;

(d)

(d) by inserting in section forty-nine after para­
g raph (e) the following new p a r a g r a p h : —

( e l ) all reasonable expenses incurred by the

S t a t u t o r y Committee in exercising and

discharging the powers author i t ies duties and functions conferred and imposed upon it by P a r t X of this A c t ;

(e)

by omitting from subsection one of section fifty- two the word " P a r t " where secondly occurr ing and by inser t ing in lieu thereof the word " A c t " ;

( f )
(i) by inser t ing in p a r a g r a p h (a) of section
seventy af ter the word " a p p l i c a t i o n " the
words " w i t h i n the prescr ibed t i m e " ;
(ii) by omit t ing from the same p a r a g r a p h the

word "ce r t i f i c a t e " where secondly occurr ing and by inser t ing in lieu thereof the word " a p p l i c a t i o n " ;

(g) (i) by omit t ing from subsection eight of section seventy-five the Avord " s e c r e t a r y " and by inser t ing in lieu thereof the words "Ch ie f J u s t i c e " ;

(ii)   by omitting from the same subsection the

w o r d " c o u n c i l " and by inser t ing in lieu
thereof the words "Ch ie f J u s t i c e " ;
(iii) by omit t ing p a r a g r a p h (f) of subsection

nine of the same section and by inserting;

in lieu thereof the following p a r a g r a p h : —
(f) if he is remoATed from office by the
Chief Jus t ice .
3. (1) The Legal P rac t i t ione r s Act, 1898-1935, is
fu r ther amended—
(a) by omitting from subsection one of section
seventy-five the words " o f the counc i l " ;
(b) by omitting from the same subsection the word
" h e r e i n a f t e r " and by inser t ing in l i eu thereof
the words " i n this A c t . "

(2) Subsection one of this section shall be d e e m e d to have commenced on the first day of J u n e one thousand nine hundred and thirty-five.
